NCO troubles

I am new to this forum.  I am desperate for help.  NCO has a collection for Columbia Gas.  My attorney contacted them and asked them for a PFD.  I got that off this forum by the way.  My attorney was told they didn't know what that meant and by law they were not allowed to do it.  NCO rep. stated only the original creditor had power to do that.  Our mortgage loan is hanging in the balance.  Please help.

I'm curious what your attorney has to say about this. Shouldn't s/he have some course of action in mind to deal with this? Is it a consumer lawyer or some other type of attorney that is just trying to help out but doesn't specialize in this area of law? If NCO referred you to the OC, then perhaps that atty should then PFD the OC... Just a thought.

My attorney knows the first rep. was lying, I had forwarded him success stories reported by people on this forum in dealing with NCO.  Obviously, NCO has done PFD many times.  He did call to discuss what we will do now.  He is going to send an email to Mr. Barrister direcly, as many have reported doing with success on this forum.  I just don't know how/why this guy lied and said a) he didn't know what a PFD was and b) that NCO had no power to delete items it is reporting.  Smiley Sad

The most likely answer is that the letter was handled by a CSR book monkey that has no clue what the laws are. This happens a lot. 99% of the collectors out there have no training and do no independent research on credit reporting and collection law, and just do what the computer screen tells them to do. It's very sad. Good luck with this. It is my sincere hope that having an attorney on your side will help you get through this. Smiley Happy

Hi kc and welcome to the forum! Smiley Happy There's a wealth of information here, and many knowledgeable people to help you get credit healthy.

Based on what that csr told your atty. about PFD, it sounds like the original creditor(OC) still actually owns the account.

If that is the case, then IMO you should cease dealing with the CA and start dealing with the OC. Offer them the same pay for delete, as you did the CA.

How old is this collection? It might help us make better recommendations if we knew the details.

The account is only from September of 07.  We had our gas service disconnected ourselves and didn't realize they had sent out a final bill afterward.  The debt is certainly ours, we were just unaware of it.  I am not even trying to get a deal, I have given my attorney the whole amount due $339.00.  I got a ltr from NCO, immediately called them.  This had not been put on my CR yet.  I paid them half immediately, set up a payment for the next month, and was told by two different people (including a manager verifying payments)  that since I had paid so quickly, they would not report it.  Well let me tell you, they got the first payment, it cleared my account, and they reported me three weeks AFTER payment.  I then cancelled my second payment.  Hence the $339.00 balance.  I figured they got me, so I would use the balance due as some leverage.  Will see what email to mike barrist can do.  I am so mad.  My credit score dropped 75 points with one CRA.  I really feel taken advantage of. Thanks.

I am happy to report, no make that over-the-top happy, that NCO has deleted this account from ALL THREE credit bureaus!!!!  The email to mike barrast really seems to work.  I paid them (it was a valid debt after all) and they deleted.  Thanks for all the great advice.
