Need help to remove collection accounts from CR

I need help to figure out what we should do about our medical collection accounts. I will try to make my story short. Shortly after we got married I had a very expensive emergency surgery (didn’t have insurance at that time). We didn’t have the money to pay for all the medical bills, and on the top of that year later I had a baby so more medical bills. We didn’t have any other option rather than to file Chapter 7 only on me (my husband had a very good credit at that time). It didn’t really bother me that much, because I didn’t have established credit yet anyway at that time due to being from a different country and not having any credit cards or loans. After couple of years I’d checked my credit for the first time and noticed that I had 4 collection accounts listed there. When I contacted the collection agency they’d told me that the charges were actually my child’s medical bills. I was mistaken when I thought all my bills would be wiped out. We moved just before my bankruptcy was discharged so we didn’t get any letters or phone calls. I paid the collection balances right away, but here is a catch, somehow it got reported on my husband’s credit report. It wasn’t there before. Is there anything we could do to have this removed from my husband’s report? We’d like to refinance our house in September 2009 and would like to improve our credits by then. My credit is 627, and my husband’s is 666. I really am shocked about my score, because hubby and I have everything under his name. The only thing I have under my name is my checking account and recently opened (7 months ago) secured card with 300 CL. My bankruptcy was discharged in June 04. I thought my score would be in low 400’s. Please advice. Thanks.

Did your husband sign anything in the hospital or on any paperwork stating that he would be a person to collect money from??  Usually there is a form for the "responsible party of the bill".  If your husband didn't sign anything, I would have him dispute it as being not his.  If he did sign something (or co-sign) then it can legally remain on his CR.  This doesn't mean that he can't try to dispute it anyways, though.  If nothing else, try a PFD letter to them.  If you do this, make sure it is CMRRR.  (do a search on here for PFD for example letters)

Thanks for your advice. I don’t remember if he signed any paperwork. I would say no. It’s been 4 years now. He has filed a dispute on 9/6/07 so we’re still waiting for them to response since we disputed from annual credit report (didn’t know at that time it’s bad).

Hi there! I just wanted to give you an update on the online investigation. All 4 collections have been deleted from my husband’s credit report. Great!!!! I am curious what the score gonna be like. As of 10/8/07 it was 666 - pulled from myfico.com. Can’t wait to find out.

As of today, my husband's score jumped from 666 to 727. This is awesome!!!
