Need help with Palisades

I recently received an added derog on all 3 of my CR's from Palisades.  This was supposely bought from another collection company that the OC had turned over in 2001.  I have no documentation of the First Consumers CC account with a balance of $792.00 from 2001.  I did dispute it and they did validate it.  It seemed like things were going good with my credit repair and now this.  It hurt my credit score very much because it appeared as a newly reported account from 2-07.  Any suggestions as to dealing with these yahoos?  Do I have some leverage with the SOL?  Thanks.....

Many of us are being hit with Palisades.
#1   check to see if they need a liscensed in your state.
#2   Check your SOL
If SOL is past  DV them  make sure that you send CMRRR
In DV letter tell them that you want full documentation with signiture and complete account history.DO NOT admit that the debt is yours.

Once they sign for DV  watch CR  they have a habit of updating all 3 CRAs  almost every week.
I know that 2 of us have already filed complaints with FTC and we are both talking to lawyers about filing a lawsuit against them.
The statue says that you MUST contact CA within 30 days of being notified of the debt. If you just found it on your CR  you are within 30 days.

You must send then a DV & tell thenm also that

Re: Need help with Palisades

I have an acct from Palisades that just showed up on my credit report.  There is no account number and no OC information.  I have no idea what this is.  I haven't received a letter from Palisades. I want to send a DV letter.  Can someone give me their address or fax # to send it to?

They back down quick. I suggest you DV them and then dispute again with all 3 CRAs. I just had 2 of these fall off my EX report this morning. They are still on TU and EQ but the investigation won't be done until Sep 8 so that doesn't surprise me. Here is the entire DV I sent them.....

Re: Collection Account #: xxxxxxxxxxxxxxxxx

To Whom It May Concern:

This letter is being sent to you in response to an entry made on my TransUnion credit report dated July 16, 2007. You should also be aware that reporting inaccurate and unsubstantiated information to a credit reporting agency might constitute fraud under federal law. Additionally, you should also be aware that sending unsubstantiated demands for payment through the United States Mail System might constitute mail fraud under federal and state law. In addition to the debt validation form below, please attach copies of:

1. Agreement with your client that grants you the authority to collect on this alleged
debt, or proof of acquisition by purchase or assignment.

2. Agreement that bears the signature of the alleged debtor wherein he or she agreed to

I require compliance with the terms and conditions of this letter within 30 days or a complete withdrawal, in writing, of any claim. In the event of noncompliance, I reserve the right to file charges and/or complaints with appropriate county, state and federal authorities as well as the Better Business Bureau for violations of the FDCPA, FCRA, and federal and state statutes on fraudulent extortion.

I also hereby reserve my right to take private civil action against you to recover damages.

I meet with my lawyer in about 3 hours. I will not pursue anything if they simply fall off my report. If they do not, then I have them on at least 10 violations so far.

Re: Need help with Palisades

I just got back from my consultation with the lawyer. He believes Pallisades has violated the FDCPA but he needs to verify something 1st. Because I like the OP never received a dunning letter or call if the DV I sent legally had to be followed. He is researching this and will let me know. Since Pallisades seems to be doing this as their SOP there is a chance that the DV requests we make are not legally binding them to cease reporting. However sending the DV and disputing with the CRAs has gotten their collections off my EX report and I am assuming EQ and TU will follow suit when the 30 days is up on 9-8-07. I suggest anybody who has Pallisades on their report DV and then dispute. I will update again after the lawyer lets me know.....
