Until someone does sue someone else's a$$ over this and establishes precedent, you never know what a judge will think!

I wonder if this is a random thing.  I wrote a check to them in December and nothing shows on my report.  Since I don't have a NM card or Amex, most if not all of my payments will be by check.  I'd hate to see all of those inquiries on my report....
