Not sure what to do...

I'm not sure what steps I need to take if any.  Here's my story:
Cingular sent me to collections twice without my knowledge.  The first time for a $.01 balance!
I made them write me a letter to show it was an accting error.  We were buying a new home and needed that to close.  In the letter it states they would contact all three CRA to have it removed.
The second time they sent me we were being transferred from KS to IN I called Cingular and asked that they transfer my contract to the new state. They said they could not.  The girl I talked to said she would put me on the lowest plan (which she did not do) and not to use my phone after 07/17/2000 (I didn't).  I would recieve a final bill in August.  I had a forward mail on file at the post office for one year.  Received my bill in August and payed the bill with a check showing our new address.  Never heard anything else.  Fast forward 18 months transferred from IN to MO  Cingular was on my CR!!  Called Cingular asked what was going on and explained what I was told to do from thier customer service dept.  The customer service rep said they had an address for me in Kansas that was an apartment.  I said I never lived in an apartment.  They changed my address without my knowledge! But, I told them  that if I truley owed money to please send a bill to my new address in MO.  I also informed her there should not be any calls on the bill after 7/17/2000.  Well long story longer I never received anything.  AFNI sent me a bill about three years later and I contacted them and told them I didn't owe it.  Now 6 months later Riddle and Assoc is calling.
I don't think it drops off for 10 years if they can use MO as the state.  What burns my butt is I still use Cingular to this day and tried to work with them IF it was my bill.
If I still have your attention....What should I do?
Thanks!

Re: Not sure what to do...

CRTP(Credit Reporting Time Period) isn't a state thing. It should drop 7-7.5 years from DOFD.

Is it currently on your report and if so who is reporting?

Re: Not sure what to do...

I forgot to add...Cingular said my contract was not up  and I owed for 6 more months.  If that is true I would owe around $60 to $70.  It's reported I owe $170 ish.
Not sure if this matters but two of my scores are in the mid 700's the other is high 600's.
Thanks!

Re: Not sure what to do...

I'm not sure who is reporting because I didn't pull my CR recently.
I am in the process of doing this.  I thought state laws trumped anything else.
Thanks!

I don't know about state laws trumping.........is there a MO state law that says it is to be reported for 10 years? I live in MO and my items have fell off at 7-7.5 years.

Are you maybe thinking of SOL?

Re: Not sure what to do...

Yes, you're right!  I was thinking of SOL.
So if I paid what should have been my final bill in 8/2000 it should have fallen off by now.
I need to get my credit report pulled.  I will be sending a certified letter to the head honchos at Cingular too!
So if something should have fallen off can Riddle still be calling me?
Thanks again!

They can no longer report after CRTP is up.

They can sue at anytime but won't likely win if past SOL and you appear in court.

They can try to collect as long as they want to. Once you are sure it is past CRTP and SOL, send them a FOAD letter.

Re: Not sure what to do...

Federal SOL on cell phones is 2 years.......state law never trumps federal law UNLESS the feds ok it and that is not the norm.

The CAs buys these accounts but never get any info.   If the DOFD/DOLA was in 2000  it would drop this year.

Send them a DV  CMRRR    and send the past SOL letter

Sidewinder,

I have my handy dandy abbreviations list next to me and started to look for FOAD.  HA!  I guess I don't need the list to know what that means!
