Now I'm Totally Confused!!! Help!!!

   All,

I'm going to take a deep breath before I go absolutely crazy! <breathes>

Okay, first off--thanks to everyone for being so incredibly helpful in answering my questions the last few weeks. The thing is, as soon as I feel like I understand what my next course of action is, I read a bit more, absorn a bit more, and then feel completely confused. I'm a reasonably intelligent guy, but I feel like I'm lost in a maze . . .

Here's the situation; can someone please advise me as to what I should do next, I have conflicting info running in my head:

I have three collections accounts on all three reports--all medical bills that stemmed from a move I made in late 2005/early 2006. I am currently in the market for a house (I recently made another move to a great city for a great job), and I'm looking to get my CS up as high as I can in the next 2 months or so.

One collections account (for $540) has been pulled back from the CA by the OC after I negotiated a PFD with them. I have a letter confirming that they have done this, but the OC says it could take up to 90 days for this fact to hit my reports. I am looking for the best way to get these to move off faster. I originally thought that DV'ing would be the way to go, but this is clearly past the 30 day deadline. Would Disputing this account with the CRAs be the best way to go? How should I proceed in order to get the CA to move faster on deleting this collection?

The second medical collections account ($279 with NCO) is one that the OC would not pull back from the CA. It seems like DV'ing isn't an option, as it is past the 30 day deadline. My thought was to try a PFD. Would this be the right approach?

The third medical collections account ($234 with NCO sold to them by the same OC as the $279 one above) is a mystery. When I called the OC, they did not have any records of this account, and they do not know where it could have come from. Some reports have this as being opened in 2001, and some have it listed as April of 2007. I was originally going to DV the CA, but again, this is clearly beyond the 30 day deadline. Should I dispute this account with the CRA's? What is the best way for me to get the CAs to stop reporting this bogus collections?

Any help you could offer me would be greatly appreciated. I feel like I'm spinning my wheels here.

Re: Now I'm Totally Confused!!! Help!!!

You can DV anytime-
Per FDCPA It needs to be within 30 days of notification of the debt-

However- unless they sent the dunning letter to you certified mail- how can they prove that they sent you a letter?

IMO- this is why DV after the 30 days still works-

So, you are saying I should still try and DV the 1st and 3rd Collection Accounts? Would Disputing the 1st account be a more efficient way of having it erased from my report?

The way I understand it, you can not DV a OC. You stated the bill has been "pulled back from the CA" so who would you DV?

In my own OPINION, if it were me in this situation and I knew the bill was mine and had the money to pay(which I'd make sure I did before I sent a PFD) I would take the PFD as soon as they agreed to it. Yes they said it could take up to 90 days because they don't want you calling 2 days after payment is received by them and every few days after until it is removed.

If the OC is not reporting and accepted a PFD and has pulled the account back, then why not pay them and then DV the CA. They can't validate if the OC pulled the account back, right? Is way I see it, but I could very well be wrong.

   Sidewinder,

   Thanks for the response!

I don't want to DV the OC, I want to DV the CA, which should not be able to validate the debt if the OC did what they said they would do. Correct?
