OC is not on CR, but Midland is trying to Collect!!!

Hey everyone!
 
I got a letter from Midland yesterday about a Citi account they claim that I owe. Now the thing is, I didn't have a citi acct and I have old reports to prove it. I am still going to send the DV out on Monday via CMRRR. But my question is, can Midland put this on my CR without an OC being on my acct. I mean if the account was mine, why is Citi not reporting it as a charge off or bad debt. There is no way this acct can be older then 7 years as I am only 23 and got my first credit card when I was 19. So I know that this is not an old acct. Midland did state in the letter that they will not report a debt that has not been previously reported, but I don't trust anything that comes from a CA. So I would love to know anyone's thoughts on this.

If you are certain this debt is not yours, you need to send Midland a DV right away.
 
Doesn't matter whether the OC is on your CR or not, a CA can report. Some OC's never report.

Yip!  Is the same for many of us here with Midland.  I have  asked many questions here about how to handle them.  Since I am still in SOL, I think I should just leave them alone.  They report like clockwork as if I had a revolving account with them.  Equifax says this is allowed!  Original creditor is nowhere listed on any credit reports and do not need to be, from what I have been told.  Looks like I have another 4 years or so before I should even challenge them.  Good Luck.  I have read many complaints, but I do not know if there are any success stories out there in dealing with them!
 
Sounds like you have grounds to dispute the information like hell!  Wait until someone more knowledgable replies to your post, but yes, this is typical Midland behavior.  If you are in a position to take them on, go for it and do it early before the cause more damage!   Best of luck!

Midland is my nemesis.  The alleged debt is in SOL, but without validation or guarantee of delete I will not pay it (a second time for payment - long story).
 
To date I have DV'd them three times, disputed on all CRAs (TU deleted immediately, the "E's" verified, Equifax "verified" with an undeliverable address but has so far refused to delete).
 
Because I am able to and grudgingly willing to pay (extortion is the word of the day) to get rid of this, I went the route of filing complaints with the California BBB, California Attorney General, New York Attorney General and FTC.
 
Waiting, waiting as they continue to add to the small balance. 
 
The alleged debt is $336.  The first time the reported it they reported $376.  Updating a month later they reported $416.  In my state, max interest rate is :
 
NEW YORK, the legal rate of interest is 9%; the general usury limit is 16%.

I rather doubt that means 9% a MONTH, but am sure that the tacked on amounts are fees they are claiming for collection of the alleged debt that they can not validate.

There will be a party the day they are gone from my life.  Since they are reporting variously as 120+ late accounts AND collections on two reports and only started reporting in 12/07, I'm hopeful there will be a ginormous score increase.

So you sent them a DV three times and yet they have not sent you anything. I am in the same boat with Hudson and Keyse. I filed a complaint with the FTC and BBB. They will not validate, but yet they keep reporting. So I sent disputes with all three CRA's. Just keep your paper trail if they try to take it to court. You will have you proof that you tried to work with them. They usally don't show up anyway.
 
I am still going to send a DV to Midland because they have to work hard to try to prove this debt. I will pull my reports once I know they have the DV to see if they report. I got a letter a while back about a Citi acct from an attorney's office, but never responded since I knew it was not mine. They didn't report anything on my credit either, so I didn't waste anohter minute on it. But I don't want to take a chance with these A-holes (Midland) , because I have heard to many bad things about them.
