OH MY GOD!!!!!!

I logged into my Cap 1 account to print off my statement (which I PIF), and there are 3 charges on there from something called E-games for a total of $310.  My credit limit is $1000 and it shows an available balance of $0.
 
I call them up, and they say that it is all from this E-games place, and I am over my $1000 limit.  What the h*ll?  I have not used this card since the statement came out.
 
The rep wanted me to call the merchant and settle it with the merchant.  What?  That is stupid.  I think I know what I charge.
 
Finally, the person changed my account number and put a fraud activity on my account.  This is amazing.  They have been charging my account $100 to $110 each day (sometimes multiple times per day in this amount). 
 
First, how can Cap 1 not catch this up front?  I am not mad at them for this happening, but it is so different than anything I have ever done.  If I charge $30 in a month, that is a heavy month.
 
Second, how can they ask me to talk to the merchant?  That is stupid.
 
Has anyone had anything happen like this?  I better not be responsible for any of this balance, since none of it is mine.
 
I cannot believe this.  What do I do?  I have never had anything like this happen to me.  None of my other CC's have anything out of the ordinary.  WTF?

They should immediately credit your account and investigate the charges.

Be very specific to what you want them to do as far as the acct number goes-

They will most likely- mark old acct lost/stolen and create a new account with the old accts history

According to them, they said if it was fraudulant, then I would not be responsible for the money.  Also, they said I would not have to make a payment on it.
 
They are sending me some paperwork to fill out and send back to them.  I am just in shock.

Paperwork?

Yes- No payment on "DISPUTED CHARGES" if you have any previous balance you will need to make a payment.

According to their rep, I have to fill out some paperwork and send it back to them.  I assume I write the charges that are not mine or something like this.  I am not sure.
 
They said it will take 5 to 7 days to get the paperwork and then another 7 to 14 days to resolve the investigation after they receive the paperwork back.
 
I just want them to charge my account back, give me a new CC with a different account.  And put the people who did this in jail.
 
Probably too much to ask.

Doesn't sound like to me protection of their customers accounts aren't their top priority.

Cap1 does not give to option to dispute charges online anymore-- did not even notice.

I just called the phone number that they gave me for the "merchant" that charged my CC.  From what I can tell it is a gambling company.  WTF?
 
I have never used my CC for gambling.  How did they get my info?
 
Cap 1 better not give me a hard time with this.  I cannot believe I have to sit back and wait on their paperwork.

Do you have a fax machine capable of printing a fax confirmation?  If so I would get the paperwork, fill it out, fax it, and note that the fax confirmation would be considered proof of delivery.  Also make them aware that you want the card replaced and accountnumber changed.
 
You made me check my Cap1 card with that one.  I think E games is an onlines hoping place to buy and paly games.  Looks like someone got your card number and distributed it totheir friends...sucks. Just checked the site and it doesn't look as if they require the three-digit CVV when paying by card either.

I am sorry to keep freaking about this, but has anyone had something like this happen to them?
 
Also, will this report to my CRA's as a maxed out CC?  How will this 'closed" account show on my report?  Or will it still show as only 1 account but with a different account #?
