Old Collection

On my EQ CR, there is an old All American Fitness account that was opened 7/2000 and shows a balance of $608.  The status shows as 120+ days past due.  I attempted to cancel this account back in 1999, but it reported on my CR because of a contract that I was in with them.
 
My question is this:  Shouldn't this be off of my credit report by now?  Is it still showing because the account status is open?  Should I, once again, dispute it with the CRA or should I do a DV with All American Fitness?

Sounds like it should be obsolete. Do you have the DOLA/DOFD? These dates can be found on reports directly from the CRAs.

Payment Terms

They are showing this account as more than 90 days late on three occasions, one of those times being this past year.  I haven't ever paid anything on this.  I did not want to be in the contract in the first place.
 
So I guess since the DOLA is in 2002, it is going to be awhile yet before this comes off.  Go figure.  I don't even know what they based that DOLA on.

It reads as tho you were still paying on it in 2002. If correct, yes it will stay on your reports till '09.
 
I'd still get a report directly from the CRA to double check the dates.
 
You can contact the OC to ask for the account history.

I believe DOLA is what SOL is based on and DOFD is what the 7 years reporting time is based on. DOLA is last time you made a payment, I believe. While DOFD is the the date you first became deliquent and never caught up.
 
In your first post you said that the account was opened 7/2002, but later say you attempted to close it in 1999. Confused how you tried to close an account before it was opened.
 
You can call the credit reporting agency, Equifax in this case, and ask what the DOFD being reported is. It should remove 7 years- 7.5 years after that date, sometimes a few months before the 7 year mark.

No, it says on my credit report that the date opened was 7/2000.  The DOLA says 2002.  I thought that I got into this contract some time in 1999, but I guess it was in 2000.  I never paid ANYTHING, because I didn't want the contract.  I was trying the place out but decided I didn't want a membership.  They told me I could not back out of the contract.  I never paid ANYTHING, so I don't know where the DOLA comes from.  Is that the last time they attempted to collect?

You must pull your CR     im guessing that if this is on your CR  it is being reported by a CA (junk collector)     check your state to see if CAs have to be licensed  if so are they?
 
If they are    DV the CA   CMRRR!   always keep hard copies of CR forever  for just this reason.
 
make changes where needed.....naver talk to a CA   never sign your name just type it!

To Whom It May Concern:
This letter is being sent to you in response to a notice sent to me on DATE. Be advised that this is a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b) that your claim is disputed and validation is requested.
This is NOT a request for “verification” or proof of my mailing address, but a request for FULL MEDIA VALIDATION made pursuant to the above named Title and Section. I respectfully request that your offices provide me with competent evidence that (a) the account is valid, (b) the amount allegedly owed is accurate, and (c) I have a contractual obligation to pay Debt Collection Company Name for this alleged debt.

If you can NOT validate your claim, you can NOT, by law, collect on it, or SELL it to another collection agency. Also, reporting a debt to the credit reporting agencies that can not be validated is a violation of the FCRA (Fair Credit Reporting Act), and carries a $2500 fine to be paid to me. If your offices attempt telephone communication with me, including but not limited to computer generated calls and calls or correspondence sent to or with any third parties, it will be considered harassment, and I will have no choice but to file suit. All future communications with me MUST be done in writing and sent to the address noted in this letter by United States Postal Service.

Still say get reports directly from the CRAs AND contact the OC to request a complete account hx.

Absoultley DV them! Make them send you a copy of the ORIGINAL written contract WITH YOUR SIGNATURE on the contract, if they cannot provide that then they will have to remove it from your CR.
 
This is considered a written contract and has the same SOL as contract signed when you buy a car.
 
If the account is still showing as OPEN it will not drop off the fact that they are still reporting as if you are paying is a NO NO!!!!!!!!!!!!!
