PFD Letter - Credit Management

I recently sent a PFD letter to Credit Management Intl for an account I had with AT&T Home Entainment.  In my letter I stated "In the spirit of compromise, I am willing to pay this account in full ($363.00), if you agree to immediate deletion of this account from any and all credit reporting agencies (Equifax, Experian and TransUnion)."

They responded to my letter saying that once payment in full is received this account will be updated as paid in full with the national credit bureaus.

Are they saying that it will be updated to a paid in full collection or will the account be updated as a positive paid in full??

If they are going to make it a PIF collection how should I go about getting them to ultimately delete this item?

Any help would be appreciated.

Re: PFD Letter - Credit Management

Sorry, but they are saying that they are going to mark the collection as "paid in full" rather than deleting it. I'd send the PFD again and kindly point out what you want.

Re: PFD Letter - Credit Management

I was thinking of making it a half PFD, half GW letter?  Meaning explaining my circumstances of how the account went to a collection and why I am needing to pay in full for deletion.  It got to collections b/c I was laid off from work for over 6 months.  At this point I am looking to have it deleted b/c I am going to be engaged very soon and will be looking for a house for my wife and step daughter.  I thought if I would explain those circumstances and offer again to PFD they might be receptive.  Do you think that is my best option?  Or should I just send my PFD letter again along with a copy of their letter stating I am only willing to PIF for deletion?

Re: PFD Letter - Credit Management

are you past SOL?  If yes, point out that by agreeing to YOUR terms that is the only way they will ever collect a dime.  That you will be happy to live with it until _____ as unpaid since paying it and still having it on your report is of absolutely no benefit to you.

Re: PFD Letter - Credit Management

They state in their letter that AT&T submitted this item to their office for collections on July 23, 2003.  The SOL in Texas from what I have read is 4 years so I would be passed the SOL.  Thanks for the advice.

Re: PFD Letter - Credit Management

What is the DOFD or DOLA showing on the reports?  Curious as to when it will drop on its own.... which it will if it was 2000 or earlier.

Keep that in mind for more nego power for a low settlement and early deletion since you are out of collecting SOL anyway.

Also check out DVing before you do anything.

Re: PFD Letter - Credit Management

you would be past SOL...they can not sue you!.....send them a DV   CMRRR.......make them prove that the debt it yours and that you owe it. If they do not answer with the complete info. they can not report!!!!!!!

The DV  is always the best way to go with a CA.....most do not know the law or don't care...they take the chance that you don't know either.

Never talk to a CA on the phone!!!!!!  Never sign a DV   just type your name!!!! Always send DV   CMRRR

A PFD is sent AFTER  they answer a DV  with all info.

Re: PFD Letter - Credit Management

I should have DV'd before I sent the PFD.  Dumb move on my part.  I am slowly learning thanks to all the valuable information here.  I dove in to quickly instead of reading everything beforehand.  At this point is it too late to send the DV?  I have offered to pay, but no were in my PFD letter did I actually say this account was mine.

Don't sweat it, go ahead and DV CMRRR.  If your PFD was from this site, it included the fact that you were disputing the debt and did not acknowledge ownership so you are OK as you are saying.  In the future, yes DV first... but don't let that stop you now.  If you intended to dispute the CA's TL on your CBRs do that when the CA signs for the DV.  Be pretty funny if they cannot validate... oops they shoulda taken the PFD!  Smiley Tongue

Don't pay first and hope for GW on the paid collection.
