Pay for Delete Question!

Hello all,

 

I recently had success with a collection agency doing a pay-for-delete. I am just waiting for one last credit reporting agency (Transunion) to remove this negative mark from my credit report. 

 

My question is after they remove it, will an employer ever be able to see that it was there in the first place? Or hypothetically, government agencies and anything else that can run extensive background checks? My understanding is that once its removed its like it never happened...

 

Also, once I see it is gone from my credit report will it not show on any background checks anytime thereof or is there a period of time that must pass for it to be gone for good.

Only public records will show.If your credit is checked they can only go off what's in profile.I do know if they search deep enough it might be found but if it's not a serious government job like secret service or head of a finance dept then I would not worry.Good luck !

Your question relates generally to the distinction between credit report exclusion and credit report deletion.

 

Under the FCRA, adverse items of information all have exclusion dates imposed on the CRAs, which prevent, after the expiration of the pertinent exlcusion period, the CRA from continuing to include that adverse item in normal credit reports they issue.  Collections, for example, become excluded from normal credit reports no later than 7 years plus 180 days from the DOFD on the OC account.

 

Howver, the information is not DELETED from the consumer's credit file.  It is blocked from normal credit reports.

Under certain conditions, the normally excluded information can still be requested by others without any exclusion.  Those conditions are set forth in FCRA 605(b), and include potential creditors with whom you seek credit in an amount or $150K or more, or potential employers with whom you seek a job paying $75K or more.

 

In distinction, if you obtan a deletion, such as via a PFD, the party reports the deletion of their nformation from your file.  It is gone, and no longer attainable.

Thus, wating for credit report exclusion of a collection, for example, is not the same as obtaining a PFD deletion of the collection.
