Permissible Purpose?

I signed up with Windstream Communications (formerly Alltel) for a bundle of phone, Internet access, and satellite television. All billing will be done through Windstream, and the only time I will have contact with Dish is for tech support on their satellite service. I was informed of (and I guess had no choice but to consent to) a credit check to be performed by Windstream. Does that give Dish permissible purpose? Or can I write an impermissible purpose letter to Dish?

Attention: Echostar (also: Dish Network)
5701 S Santa Fe Dr
Littleton, CO 80120-1813

Dear Echostar,

This letter is a formal demand that you immediately contact Equifax, where your organization has made an inquiry into my credit history, to have your illegal inquiry removed. Be advised that I will be checking my reports to ensure you have had the following unauthorized inquiry removed:

Made by: Echostar

Made on: 03/28/2008

Made with: Equifax

I have not signed any documents authorizing your organization to view my credit history therefore, your inquiry into my credit report violates the Fair Credit Reporting Act, Section 1681b(c): Transactions Not Initiated by Consumer.

I have had no direct contact with your company regarding a credit report, and my involvement with Windstream Communications and my authorization to them for an inquiry into my credit does not authorize Dish Network to access my credit report.

Once again, I am writing to request the removal of this inquiry from my Credit Report.

Sincerely.

(Me)

Re: Permissible Purpose?

So what do you think? Have I got a leg to stand on? I'll try calling them first and asking them nicely to remove it (fat chance that'll work, but maybe).

Would have been nice to see how this ended.

Re: Permissible Purpose?

Somewhere in what you agreed to was a Windstream "and their affiliates" clause, or legalese to that effect.

no sane business just runs credit and pays the fee for no reason.

Re: Permissible Purpose?

I would have to agree that DISH is allowed the inquiry.  I have a bundle through my phone company and they offer TV through DirecTV.  Both pulled my credit.
