Please help!

My husband have a medical collection on his CR that is from 11/00.  I called the original credit because at that time we did not have HI and they cover the bill with financial aid program they had at that time.  I called yesterday to find out why we were being charged 455 from a place called Diversified Emergency Services and she said that they hospital delete the account balance but not the doctors bill, so we have to pay.  The hospital provide me with the number for the original creditor and they said that there is no account for that date of service, however they found 2 more that I was not aware of (not in CR).  I called the CA again to tell them that OC does not have an account for that date and they are not willing to hear me.  The only thing that they repeat is if he went to the hospital he have to pay.   What can I do?  I was thinking to send a PFD since is the only thing is in his CR unpaid but is a really old account and the OC does not have record.  Is that possible.  Maybe another company with the same name?

Another question!     What should I do with the two that are not in the CR.  They were not sent to the health insurance so they will probably pay the claims once they received.

I hope someone can help me.! Thanks!!!!

Re: Please help!

I would actually dispute it, since it sounds like they don't have the documentation to verify the debt and if they send you a collections notice,  DV them

Re: Please help!

It sounds like the OC sold all the info to the CA. and did not retain records for themselves. That's a little strange that they didn't retain copies.   But it is good in a way since now you won't get two dings on your report.
Why should you pay them?, well to be blunt, because you owe it and they could legally persue it.  It doesn't matter in the eyes of the law that they, NCO, is a collection agency or the fact they bought it for pennies on the dollar, in the eyes of the law, they legally hold the right to your debt.

Yes try a PFD with NCO .

Re: Please help!

Also what state do you live in?   what is your state's statute of limitations,  it may be time barred.  And if send them a cease and desist letter stating the debt is time barred and beyond your state's Statute of LImitations.    But you have to check your state first before doing anything.

Re: Please help!

Ok  so it looks like it will stay on your credit report until 11/2007.   The one thing I'm not sure on is where Medical Collections falls under.  In Ill. there is a huge difference between written contracts and open ended contracts.    Written is 11 years  when speaking of the state's Statute of Limitations

It 5 years for Oral and opened ended contracts   and 11 years for written and Promissory contracts.

Medical collections is definilty not an open ended  so it would be between and Oral and written.   That is a six year difference.
