Prosper sending me harassing email

Got an email from Prosper that my "loan will be sent to collection agents after 15 days past due and my credit report will be impacted."

My account is in good standing. they are sending me a threat?

I have had this loan for about a year and a half. Up until last month I was always on time. But I lost my job and my bills are catching up on me.

I have to play who to pay roulette. This last month I was 27 days late on the prosper loan but I have never been past 30.

So now I am getting harassed from them about this and they are threatening me with reporting to my credit report after 15 days late.

Makes no sense. Am I correct on this? Or did something change that I am not aware of?

Re: Prosper sending me harassing email

They can charge you late fees but the loan can't be listed on your CR's as late until you cross the 30 day period

Before you app think...
Have you done your research of the CC?
Does it fit your spending?
Do you have a plan for the bonus w/o going into debt?
Can you afford the AF?
Do you know the cards benefits? Is it worth the HP?

That is certainly not what I would call good customer service, but technically they can refer any debt for collection the day it becomes delinquent.

I would ignore simply ignore them, but be aware that they likely will take a very agressive collection practice should you become late again........

Re: Prosper sending me harassing email

I was always paying by bank transfer on the 5th of every month. i called and spoke to a rep and he said I could undo the auto-debit since I am not currently working and use up to 15 days to pay it manually. He said a late fee would apply after the 15 days if I was unable to make the manual payment.

So, I get that a fee could/will apply. I don't get how they can threaten me with a derog on my CR. I have forwarded their email to my lawyer to get his take on it.

You have money for a lawyer, but no money to make the payment?

Hard to assert harassment when they are simply stating a fact....

It can be viewed as a helpful warning of their intentions.

+1 For sure not harassment. You owe and its that simple. And they have a right to use any legal means to collect on your debt. After all its only a email and they got that email address from you. I could see if they were calling you on the phone at midnight. Or doing the robo calls consisting of 100's of calls each day. I Also understand the hardship of losing your job. I hope you can find a way to pay and get out of the bad situation. But they could care less of you forwarding things to your lawyer. Once it hits collection of course your score will crash.

I appreciate the replies. However, let me state that I am not late. I have paid the account on time. It was only last month that the account was past due 27 days.

The email sent to me from prosper stated that after 15 days theywill send the account to collections and it will have an impact on my score. They are threatening me since it takes a delincuency of 30 days or more to have an impact on my Cr. That is what I was referring to.

While its true an OC cannot report a 30 day late until you actually are 30 days late a CA is not bound by any such law and if they send it to a collecor they can report it at anytime. While I personally think it is stupid to send an account to a collector at such an early stage there is no law that forbids them from doing so even if you are only 1 day late.
