Mornin' All,
Y'all are the best and it's time to go back to the well with a question. I was just reviewing my CR's and noticed a bunch of Public Records (5 in total) on EQ. They all have the same date 12/31/0000, Type - UNKNOWN, Plaintiff - No Name, Reference # BVxxxxxxx. They are very foggy at best and I'd like to address them if possible. What would be the best route to take???
I know someone here has the answer and others that may be in the same boat that need the info as well so let's hear what the experts have to say!!!
CCT reports a generic date for my public records on EQ...
Try to view them on your actual reports (or elsewhere) for more info.
Pull your own public records. This can be done online for many jurisdictions, but not all. In my county I can go to the Clerk of Courts and complete a public record search to see what is recorded. Some counties you actually have to go to the courthouse.
Great idea but I was moving around all the time until 2010. I was a construction superintendent and moved every couple of months. Not having a permanent address I never applied for any credit to have these listed at all. Not knowing who/where they came from or what they are about makes it hard. Can PR's be deleted from a CR???

Public records can come from anyone: the IRS for example or unpaid traffic tickets or a collection account that has been turned into a judgment. Check each of the counties were you were because the most common thing for CA's and OC's to do is to obtain a default judgment by using the address they have on file for you. They are supposed to serve you for the lawsuit for the judgment, but many CA's and OC's do 'sewer service' (not actual service to you). This is a good reason to get the judgment removed BTW.
Having the public records on your CR is just part of the problem. The real issue is the public record itselt. It can last 10 to 20 years and accrue interest the entire time. The amount of interest is by state statute so look up that information too. If it remains unpaid for the 10 or 20 year period, depending upon your jurisdiction, it can be renewed for another 10 to 20 years. Take care of the judgment. Have it vacated if it isn't your judgment. If you pay it, make sure there is a recorded Satisfaction. This is a bigger deal than any collection you have have on your reports. Read up on your state's statutes to see what the jurisdiction is for your area. Here it is 20 years + 20 renewable - in short, a lifetime if it isn't paid.
Okay, I have no IRS or Traffic dings. I did find 1 acct that is a judgement that is incorrect and needs to be fixed and I have a CO from Cap1 that went to court and is reporting a judgement. They show up as 2 seperate dings. Nothing I can do about them and Cap1 has given me 2 new cards last week so they have forgiven it. Last payment was 6/09 and last reporting date was 3/10 but the judgement 12/10 for $3040. The others with "Unknown" info are the ones that concern me. They only show up in CCT and are through EQ exclusively. How can you find out what they are without costing something? It seems like it all has a cost when trying to fix this stuff even when some of it may not be mine.

I just pulled the trigger on the annualcreditreport.com so I'd have a good picture of the past as I move forward. They don't show up on any of the TRUE reports so I'm not sure what they are.
I guess if they're not in the actual reports then I shouldn't worry about them, huh???
I did find a couple of things that I wasn't aware of that DON'T show up on CCT or CS, CK for that matter and they are real so I'm going after them tomorrow when everything is open.
I also found out that 2 new accts are reporting already and I only got them last week. They have 1st mnth "Pays as agreed" and green's and I haven't touched them or gotten my cards yet! They are Overstock.com and SYNC/AMAZOM PRIME. Actually, the amazon acct started reporting within 4 days of opening the acct. Very happy with new accts reporting so quickly to balance out the HP's they cost'd me.
The fact that you did not receive a personal, in-hand delivery of a notice/summons does not mean it was an improper "sewer service," where the process server lied about the means of delivery.
Rules of civil procedure of the court provides for service by means other than personal delivery when attempt at personal service has failed.
Publication in local newspaper, for example, may have served as notice.
You need to contact or visit the office of the clerk of the court and review the court records, which will record the method of sercice accepted by the court.
Whether or not there was an error or lack of compliance with the rules of procedure for that notice will then depend upon the facts.
As for removal of a judgment from your credit report, as stated, the judgment is the public record, not the info provided in your credit report.
Review the court record and determine if there is some basis for vacature, such as error in the proceeding, and whether or not the peirod for requesting correction or vacature has expired. Most courts have periods, in months, in which an error must be addressed.
If Cap1 went through the trouble to get a judgment, I think they are going to want their money. They may let it sit a while to earn more interest, but eventually they will come after you. With a judgment they can pull the money out of any bank account (with a few exceptions). They don't need to let you know before hand. The money will just be gone.
Are you planning on entering your bank account into Cap1's website to pay the CC bill? Or are you planning on pushing payments from your bank?
