Question on Statute of Limitations

Here's my question- I live in Texas now, and I know the statute of limitations is four years- does it matter that I was living in another state when the debt was incurred?

Also is the SOL different for student loans?

Re: Question on Statute of Limitations

The SOL applies to where they were to sue you-
They can sue you in TX or the old state- location determines SOL.

There is NO SOL on student loans-

Re: Question on Statute of Limitations

Tolling may come into play, I'm not sure if all states allow it but I do know NY does.   Tolling is when you incurr a debt in one state and when you leave that state the SOL is frozen from the time you left.

As someone has posted it's a good question for an attorney as for if all states have tolling and if tolling is indefinite or such.

And yes there is no SOL on Student Loans.

Re: Question on Statute of Limitations

If it is considered tolling, then the debt could be sued over 50 years later?  How do you know if the SOL was put in a tolling status?  I have been moving about every 3 years for that last 20 years.  Does that mean that I could have some debts that are in a tolling status?

Re: Question on Statute of Limitations

There are ways to research it online and by going to each states website.    I don't know if this applies to all states etc.     I would try researching it first  but if you can get a free consultation from a debt attorney that would be helpful.
