Reinserting derogatory information

I have a car loan with one of these "buy here, pay here" kind of companies.  Actually, I am a co-signor with my ex husband on this vehicle.  He had hip surgery in May and got behind a month.  It was reported as 30 days late so I took over the car and the payment.  Then, the place started reporting all kinds of crazy information.  First the reported 4/08 and 5/08 late.  I disputed and they removed it.  Then, they turned around and reported 3/08 late.  I disputed it and they removed it.  Now, we go through this process twice a month and have since May.  I've contacted them about it several times and they said that the loan was late 3/08 and 4/08 so there isn't anything they can do about it.  I've escalated this to management but to no avail.  Each time they hit my credit, it dings my score roughly 20 points.  It goes back up when they remove it only for it to get put back on.  Is there a way to stop this roller coaster short of me just accepting the late pays?  Furthermore, this last month, my EQ score was 638 with the 4/08 and 5/08 30 day late.  They removed that and reported 3/08 late and my score dropped to 622!  The only other thing that had changed on my report was the balance.  It went from $8,469 to $8,209 but I shouldn't get penalized for a reduced balance should I?  I can't refinance the car with another company because it's only worth $3,800 so I'm $4,400 upside down in it.  I just wanted to know if there was something I could do since they have removed this from my credit and reinserted it so many times.

Well, according to you, the 05/08 payment was 30 days late which is why you are makng the payments.  So I don't know what you can do about that.
 
However, was your ex-hudsband late in March and April also?  Is he being honest with you?  If he was late, then you are screwed.  If he paid on time, then you should be able to find out when the check cleared or the money was transfered from his account by looking at his statements or the backside of the copy of the check.  If they support the account being paid on time, you can send them a copy of them when you dispute.  For them to report as 30 days late, they would have to be 30 days late or greater.  However, make sure he made his payment in Feburary before you look at his march payment since somewhere along the way, he may have missed a month completely and was paying everything a month late.

I am probably going to have to bite the bullet on the 4/08 payment because that is the one that was 30 days late.  That is legitimate but they never report just 4/08 late.  They always include 5/08 too.  I guess I need to send a copy of the bank statement showing where the 5/08 payment was made (in advance no less) and see if that helps.  Thanks for your advice!
