SIMPLE LEGAL HELP PLASE. Can I tell the lender If you don't... I am going to the FTC?

I have a super subprime lender that closed an account 1 day after a 30 day late and refused further payments. They are saying take it up with the collection company. We are about to file with the FTC over damage to CR. They further kept adding 60, 90, ect and charge off and collection after the account was closed on 31 days late. Can we call this lender and say, if you don't fix this with in 30 days we "will" file with the FTC? Is that an illegal threat? Should we just file and not call the lender? A 30 day late might be valid, but thats it. Payment was denied just after the 31 days because the account was closed and sold off or something.

So can we verbally threaten FTC or do we just have to File with FTC?

I am not really much into threatening  (DH will verify that) more into 'striking without warning'....do you thinkI've told I CSysytem or the OC that I'm coming after them with everyhting I can think of from AG & FTC complaints to HIPAA violations, to contacting the insurance company and complaining about unncessary treatment (and this is all over $130)....
 
personally I like maiking someone's life a living _______ once they've pissd me off.

when you say lender specifically 'what' -  there are also other agencies that have jurisdiction depending on the 'what' they are.

1) I want to make the demand that they one "except" payment in full. I know this sounds crazy but yes, they refuse to take payment.

2) I want to make the demand that they provide in writing or remove from credit report with in 10 days.

If they fail to do this I will file with the FTC that they will not take my payment and left neg remarks after the account was closed.

Can I say this? I also wanted to call them a fraud to the FTC and have them investigated for criminal acts to gain more fees but I probably shouldn't got here since maybe this mishap was unintentional. But they still refuse to correct.

So threaten or just do it. I don't care about hurting them, I'd much prefer to just make it go away now than have to wait for the FTC to fix. So if I can threaten first I'd like to do that.

is this a bank, a Cu, etc....   Get local 9and state perhaps) consumer protection involved (the government agencies not the BBB)
 
I wouldn't threaten... write a NICE letter (combine a PIF letter (not deleting) with a goodwill letter) - but get it in writing before forking over any money.
 
Hoow Pizza would like to clear this matter up and how company can restore  faith in them by accepting payment and correcting records.  How careless it was to have not made the payment (give darn good reason not just I'm forgetful) etc....

Its a consumer finance credit card co-branded. Can we call them and say nicely, we are forced to go to the FTC. Please help save us this trouble? Or is that the same threat. I feel if we make our case strong enough they will crack. Don't get me wrong, we have every intent to file with the FTC, CPA, ect. Its not a bluff. I just want this over with the fastest way possible.

someoen regulates them other than the FTC... (I like all the leverage I can get).  If they own the debt (and I seriously doubt they sold it in one day) - refusing to accept payment on it could in itself be a violation of other regs.
 
How urgent is getting this settled?  If the CA placing lates on you or just being a CA?  Are you accumulating interest?  State consumer protection agency to mediate....

I had a new more urgent matter "collection notation" pop back up on my "Personal" cr that was in good standing. Phrase "Human Error" to describe this banks mistakes is starting to sound like "Human Error" is a condition. 3 months disputed, redisputed, reredisputed. Removed, back on. Removed, back on. I don't think this bank will let me keep this on my credit report as a positive trade line. Never late but it shows collection. This trumps the other problems.

As far as the other problem we're going to the FTC tomorrow morning. Banks play too many games and we're not getting any where. I don't get a chance to say anything because when CSR transfers my calls now they hang up on me. Give up. Going FTC.
