?? ideas??  If it will add value, I can can pay it, I don't want to it wasen't part of the deal, but the cost of the debt is less than what it is costing me now. $1700 is pennies compared to the interest rates I "qualify" for.

Paying it will not increase your score.

 

FICO sees collections as collections, paid or unpaid.

 

If beyond SOL, I would start by sending a DV. I would keep it simple, see the link in my signature.

 

If you choose to pay it, then I would offer a PFD, if they properly validated after sending the DV.

thanks for the links I the PFD will definately help. I havent' tried that one and I have done a LOT of credit repair in the last 10 years....guess I should have came here sooner. But, the SOL...I am in TX.  so I can be sued for up to 4 years, but that's not how long thye can try to collect the debt. and the CRA will maintain the record for 7 years?

SOL determines the time they have to sue.

 

They can report for only 7 - 7.5 years.

 

They can try to collect forever.

 

I would DV before PFD'ing.

As a landlord, I always get a credit report on a possible tenant.

All things being equal, the tax lien and the rental dispute would stick out.

Unless, I was desperate to fill up my units, I would ask myself "Why would I take a chance on you when I can get someone who never had these type of problems?" Similarily, a bank might ask "Why take a chance on someone who has had contentious financial issues in the past? Is this a portend for the future loan?"

 

Your past tax lien and rental dispute is not helpful.

However, your consistent regular payments are.

If your loan outstanding balances are high and increased in relation to your current income that could hold your score down.

I am sure if you tidied up your financial loose ends and over time the tax lien or rental dispute goes away in the report your FICO would dramatically improve but it would probably take a few years more.

 

But you should be applauded for trying to improve your FICO score.

I think I read somewhere in this thread that you were on the lease signed in Dec. 2001. If that is the case, if you signed the lease regardless of whether you lived there or not you are responsible for paying the rent on that lease. If no rent was paid in Jan. 2002 then that would be your DOFD. On the flip side if you signed the lease for someone to live there and they continued to pay the lease on time until 2003 and then stop paying then that would be your DOFD.

 

You are going to have to find the answer on that before the DOFD is determined.

 

If it is reporting as a revolving account, that doesn't seem to be right. Here's the kicker. I am in the same boat that you are in. I have one Neg. on my account-yep good ole "Crapital One". Everytime I get my score up to 668 or start getting close to 700, Crapital One will report-they do it every few months to hurt my score. Thank goodness it is "Suppose" to come off my CR in June 2009. I have 22 open and active accounts-owe on 11 of those accounts, the ones that are revolving accounts-CC have low balances. Open bank accounts are low bals as well. Out of all 22 accounts I have no lates with the acception of Crapital One. My CL with crapital One was $200. or $300.-I now owe them over $2100.00 all due to late fees and over limit fee's. I paid them on time every month when I opened the account for a few months-but then one day they wanted to s____ me over and I told them they world correct the problem or I wouldn't pay them a dime. Needless to say they didn't correct the problem and I didn't paid them another dime.

 

Everytime Crapital one reports-my score will drop down to the low 630's to middle 640's. Then I will get penilized by any accounts that are finaced by GE-my CL's will drop on them. So to the post from the man that said his wife opened a account in his name. It started with a $300.00 CL-but now the balance is way up there, it's all late fee's and over limit fee's. You can forget about fighting them because you can not win. You either tough it out for seven years or you pay them. My case-I just decisded not to pay. I don't have a problem paying anyone for something I legally owe, but I'm no idiot either.

 

Yes, it is hurting me as far as my FICO score goes, but every where I do business with, tells me they don't go by FICO scores anyhow, that they go by their own scoreing system and they have no problem with my credit. I have many aged accounts and no lates and that my credit report speaks for itself. Many credit companies have told me that most people that have a flaw on their CR is due to Crapital One or a company similar to them-but Crapital is the main one.

 

So back to the lease on your CR, if the DOFD was early 2002, then the DOTP is up and should come off by at least March/April of 2009. Sometimes they go by the DOFD or date of serous late payment meaning 60 to 90 days late. Contact the CRA's and ask them to send you a copy of the validation of the DOFD. Fight them with all you have and don't give up. As long as they continue to report, your score is going to drop.

 

For me-I am sure Crapital One is really pissed since it is getting close to time for it to drop off my CR's in a few months, so it is no telling what they will pull during these next three months. I'm sure they have something up their sleeve. Crapital One does not like to give up easy.

 

Maybe once they drop off my CR's, then maybe I will hit the 700 mark this year. It's sure been a long time waiting.

I think I'll just have to wait for the broken lease to fall off in a few years..When I moved out the girl that stayed in the Apt went with me to the office and she signed a new lease W/O me on it....but I didn't get a release...at they time the office said don't worry we'll just write a new lease without you on it....but after she couldnt' pay the rent....apperently the original lease came back into play....my own fault. I know now to CYA.

Capitol one..yeah exactly.....$200 CL and $2000 for the balance.. mine should come off in Feb and March (differnent dates for different reports) I hope that is the one that is kiling my score....I'll post agian after it comes off and let you know how much it goes up. I been sitt' on a 620-653 for about 4 years now. One post here (was aloto fo help "Sydwinder" ) said that Cap one Balance vs. CL is the problem....I'd have to agree because everything else is as good as I can get it.

I haven't had any trouble getting loans. and I'm self employed so I know that lenders do acualy look at the rest of your crdit history, not just the score....but the better score would make things just that much easier. I get good interst rates. just not the best that I feel I should qualify for.

I'll check for the Cap one on my report and post the new numbers again (if it's removed) around Mar 20.

Well, I checked again today and EX went from 637 to 695..Capitol One removed! SWEET!!!

TU went from 628 to 655 Capitol One is still there so I'm not sure why that one increased. but it should be off 03/2009 anyway, I guess I need to be patient until the end of the month.

Congrats!

It may be worth pulling your FICO score to see how you came out there. Maybe you gained more points.

I have a capital one charge off on all my credit report too for 2998 which credit limit was 500. Its suppose to come off in oct 09. I really dont understand how capital one can keep on tacking on interest every month on a account that is suppose to be charge off so it makes you look like you have been late recently. Lucky my scores are still 670 across the board. I was just worry that it was getting close for capital one to come off and maybe they will try something. cross my fingers.
