Should i dispute everything except....

The Medical collections? I am working on helping my cousin with her credit and she has a lot of Credit Card Chargeoffs, most of which are out of SOL, ( thank God!). She was telling me that a friend of hers disputed like 15 items and they were removed, i just want to be sure of doing the right, because i was not comfortable with disputing everything.

 

 

I dont think she is in a position to pay out a lot of money, so she wants me to do it the cheapest way that i can.

 

Any advice is appreciated!

Thats what i figured, ofcourse i would never do such a thing as far as my credit reports, so i kind of feel the same way about my clients! (lol)

So check this out llecs...

 

All but two of her negative accounts are out of SOL, so would it be wise to send 20 DV letters out at once or maybe two or three at a time?

If she has 20 different CAs reporting and are past SOL, then send a DV to each. Some stuff will fall off. Some will get reassigned to new CAs. And most of them will start calling and writing her. Tell her to ignore the phone calls and to track each incoming call. When I started all of this they came out of the woodwork. Wait 45 days or so and then send out new DVs to those that didn't respond. For those that verify and she agrees, then fire off PFDs (if that is what you want to do). Send everything CMRRR (costly but worth it). Tell her to save copies of what she sent and save everything the CA responds with.

If any of these are medical, then follow HIPAA instead.

She has two out of those 20 accts paid medicals, so hipaa process should flow easily!

Oh before i forget...she has quite a few accounts where the OC is reporting, some of these were sold to CA's and some not, do i send out GW letters for removal or send the OC Letter?

Keep in mind that the FDCPA does not apply to the OC.  I would still ask to see the last statement/invoice and summary of payments made on the account.  If it's just late payments, then GW the OC.  You can also negotiate to improve terms of repayment or settle the account.

You can send GW letters to remove. Just make sure they were actually sold before GW'ing an unpaid account.

 

However, remember that accounts from the OC still count in age and could be helping if really old.

 

What is date open? DOFD?

 

Have other accounts this old?
