Sombody Help!

I need to get any kind of help from you guys.  I learned in hard way ... really!  
 
Here is the story ...
In 2004, I did not have place to live and one of my new friend let me stay at her apartment for three months as roommate.  And I really appreciate and thankful to her and her family (husband and daughter).  While I was their roommate, she ask me for financial help of $1500.  I did help and she repaid in full by 2005 December.
In 2006 July, she came to me and ask for financial help of $600.  Since I did not have cash for that mount, I used my CC for cash advance to help her.  In 2006 September, she came back for another financial help of $2400.  She said this must pay to BofA for their Auto Loan Late Fee Charge ASAP, if not their vehicle will be taken.  So, I helped her again with my CC.
In 2006 November, she came back again for another $1350.  She said she was walking to the bank for the payment and someone stilled her wallet from her purse, and it must be pay by "today".  She was crying and crying and she even called her family in Japan and ask for help.  Her family in Japan ask me to help her and they will send the money to me.  OK, I am too nice and kind ... otherwise you can say stupid ...   I went to NFCU and got Cash Advance with my CC for her ... again.
 
Here is fact and situation ...
* Their vehicle has been taken even I helped them, because they got more late fees from bob.
* I never received payment from her family in Japan for $1350.
* She is paying to my two CICS monthly, but she late for the payments.
* I had to make minimum payment in the past to avoid the late fee and keep my CRAW clean.
* She did again this month and I can't deal with her any more.
* I ask her to pay the balance in full ASP.
* She said she is doing what she supposed to do and she don't have money to pay.
* Her husband is just got out Navy.
* I spoke with her husband before about repayment and he said he will talk to her.
* Later, he said it is not his debt, it is her debt because she did it herself.
* The remaining balance is about $1670 total. 
* I don't want to be her friend any more.
 
Where can I go to get this money right a way?
Can I go to her employer?  I have called her employer and left message "I would like to talk to the owner regarding the one of your waitress, who I lend the money."  No response.  But she already new about this call I made.
Is there any way to get the money from her husband's retirement pay?
 
Please somebody help me!!!!!!!!!!!!

You can file in small claims court. However, be aware that she possibly has a counter claim against you and also be aware that if she is paying as you two agreed.......even if she is late a few times.....the judge may dismiss your claim.......was there any agreement between the two of you as to when payment was late, what happens if she is late, etc. Even if you win in small claims.......you probably wont get your money "right away".
 
Did you mention her name or did the employer know who you were talking about when you called?
 
I'm sure you aren't going to be able to touch her husband's retirement pay.

She is working at Japanese Restaurant and I worked there when I met with her, and the people there know me too.  Oh, she borrowed the money from the restaurant owner and she was not repaying, and the owner had to ask her to repay.  According to her, the owner said she can repay any time.  Unbelievable!
I have had conversation with her when she was late for the payment as we agreed.  You know what she did to me ... she yell at me say she did not late for the cache's due date.  What this mean is I set her due date before my caches due date to make sure it will not be late.
Also, she supposed to provide me the tracking number of Certified Mail when she sent the payment to Chase.  But she doesn't.  Then I has been always have fear of been late payment all this time.
 
They has been filed BK in 2007, but it has not approved because her husband was making enough (E-8 / over 20 yrs) to repay.
 
What's mean by "be aware that she possibly has a counter claim against you" ?
Yes, you are right.  She is paying even it is late, this is not good for me when I files.
 
Oh men ..........   I am stuck with her re-payment for another 12 months ...   Smiley Mad  Smiley Sad
I can't wait to get ready of her from my friend's list.

In front of the right judge and her having the right lawyer........you telling her employer about the situation could cost YOU money. No point to tell her employer. She didn't borrow the money for him. He didn't guarantee payment. He can't garnish her paycheck. He can't make her pay. There is NOTHING he can do about, therefore shouldn't have been told.
 
Better to be stuck with her making payments for another 12 months then no payments at all.
 
Even if you were to win in small claims, the judge would probably just set up a payment plan. Or file a judgement.........then it is up to you to collect on it.

Print out a payment schedule- and a promisary note-
Have her sign it and have it notarized.

I do have payment agreement in written but it is not notarized, just her signature.
 
I was thinking to ask her employer or her brother who currently works at same restaurant to pay the balance to me, and she repays to them.  It is just repay to different person.  Then don't have to worry about she will messed-up my CR.  This was my taught, and I guess I was selfish. 
 
So, even I go to the small claim court nothing good.  Can Judge order to employer to garnish her wage because she pays late and affect to my CC late fee charge?
 
What could be happen if I go to her work and try to talk to her brother or employer to ask for help?

You need to quit contacting her employer until you have a judgment-
 
If you contacted my employer - I would sue you so quick - you would be bunny food. This is not anything you want to mess with- 
 
Rule # 26 Don't lend $ you can't afford to never get paid back or ever expect back.

So, should I claim to small claim court is the better in this situation?  Are there any cost on me?  If I am going to the court what should I bring with me?

I just checked information about small climes court at online.  It's not worth it for me to claims.  It's cost me to get the money from her.  I have to give-up ... wheeeeeeeeeeeeeeeeeeen.  Smiley Sad
 
I hope she goes to her brother and her employer to get the help,  which is borrow the money from them and PIF to me, since they (all employee) already know about it.  If this happens, it's so wonderful.

Sorry you went through that.........loaning money to anyone, friends and family included, quickly creates discontent.
 
We hired an interior designer for our home. Everything was going well and the agreement was we pay her in advance for major purchases. We gave her $1500 for a new dining room table and chairs. Times passes and we are getting nervous because we had nowhere to sit and eat. Then she stops answering her phone and banging on her front door didn't get us anywhere.
 
So we go to an attorney to get advice. We live in suburban Wash. DC; lawyers are everywhere here. What are the odds? The first attorney we talked to was her attorney! She said, "I can't help you because she is my client, but if I were to tell you anything about her, here's what I'd tell you........" Got great free advice that day. Learned that she was just foreclosed on, had a car repoed, files for bankruptcy, and that she owes money to everyone. The attorney said to pick a number. In the end, legal cousel would have cost us more than $1500 to collect it!
