Stipulation of Dismisal Question

Hi newb here, A CA decided to go to the next level and filed a lawsuit against me back in June.

The summons got my attention very fast. I contacted the atty for CA and worked out a deal. I made my last payment in December and they have now sent me a form to sign to dismiss the case with prejudice.

Not being a lawyer, I looked up "With Prejudice" and saw it was a good thing for me. My concern is this. Once the Stipulation of Dismissal with Prejudice is filed, will that create a public record? And if yes, will that hurt my FICO? And how much?

One other thing to come out of this, is that I've now started monitoring my FICO and FAKO's and have paid off several collections for significantly less than owed, and have started receiving PIF letters. :-) Thanks for your time.

Re: Stipulation of Dismisal Question

You need to get an agreement from the atty that atty will notify the CA and CRAs that this was an error.

Dismissal is good but might still get stuck on a CBR... but it can be disputed off... just keep an eye out for it.

There will be record of it at the courthouse, but this is not a 'public record' being that it was dismissed.

Re: Stipulation of Dismisal Question

welcome!

Let me elaborate on 'is this a public record?'.  Technically, yes.  For credit reporting and FICO scoring, no.  This does not mean it is OK if it appears on your CBRs... it will screw things up even though it should not be there.
