Taking Experian to Small Claims Update

Hello all,

Believe it or not, still no decision.

I'm told that the courthouse is transferring cases to their larger counterpart because of budget cuts so there are delays.

I'll keep you posted.

Yeah, no kidding. Even after showing proof to this woman she was trying to explain away what I was showing her.

Even the mediators looked at her sideways.

It's still a crap shoot though. I'm banking on the ambiguity of the Furnishers of Information laws. Either way, I'm going after TU and Equifax. All it takes is one judge to clear the way.

I would LOVE to see this work out and open a floodgate of similar actions. Maybe THEN there would finally be some accountability.

virgo - I am not sure how ethical this would be....but a thought crossed my mind.   

 

How the ruling judge, for that matter, all of the judges in that court system would be affected by a bunch of letters coming from myfico readers....

 

* a thank you for recognizing the abuse the CB are inflicting by not obeying the law...

 

OR 

 

* a disgruntled letter pointing out that CB continue to ignore the law when it suits them...

 

I haven't had coffee yet, but have been up and about for hours working...so my logic maybe fuzzy.   IF there was a large amount of mail going to the judge/courthouse, it would surely grab media attention.   That might force a behavior change from the CB regardless of the ruling. 

 

Just a pre-coffee thought.  Smiley Happy    I personally would write the judge saying thank you for their ruling in your favor even though I do not live in your state.

I hope I am continuing this in the right thread-

Well, just got an e mail from the court telling me that they have 90 days to render a decision and post.

I apologize for not responding sooner to everyone but I work out of doors with animals so my post are done using my phone and my typing is slow and lousy.

I would love to assume that no news is good news.

Amicus briefs (ones filed by those not a party to the proceeding, but expressing legal opinions) before a trial court?  Interesting concept....

 

No ethical concerns, but usually reserved for courts that create prededent.  Trial courts dont create binding precedent other than maybe in their own courthouse.

 

Best, in my opinion, to reserve such actions for if and when it reaches the appellate level.
