The BBB

Has anyone has ever had any experience with the BBB? This is my dilemma, I am currently working on my Experian Credit Report and I have two payday loans that is reporting from a company called Peak Capital. I disputed these accounts and they came back verified. I never had any payday loans, they are illegal in Georgia. The thing is, the company cannot validate the debt that they claim I owe, they cant even tell me what account these loans went in. Any way, on Sept 1, I filed a complaint with the BBB, as well as sending Experian another reinvestigation request. I just received the BBB response, here it is:

 

Location Involved:   (Same as above) Consumer's Original Complaint :This company has put 2 accounts on my credit report from a EZ payday loan which i have no knowledge of. The company will not give me debt validation nor will they tell me what information they have. This company is very rude and disrespectful. I have never gotten an online payday loan, they are illegal in my state. The company refuse to remove the false information off of my credit report.   Consumer's Desired Resolution:I just want the company to remove the negative and false information off of my credit report because i have never had a payday loan with the company ez payday loan. I also want them to provide proof of the debt that they claim i owe.

 BBB         RECEIVE BUSINESS RESPONSE : On 09-22-08 we received a consumer dispute from Experian and we responded with verified as reported. On the same day, we spoke with Ms. Hughes informed her about the problem, she stated she never opened a payday loan account. On the same day, we mailed her a Fraud Packet, which she never sent back. She is very well aware of these loans she took out09/17/2009

 09/18/2009                WEB      BBB         BBB REVIEWS CONSUMER REBUTTAL TO BUSINESS RESPONSE : (The consumer indicated he/she DID NOT accept the response from the business.)                                I never received a fraud Packet and I asked for Validation of the so called payday loan debt, and they cannot provide any validation of the debt. It is my right of the FAIR CREDIT REPORTING ACT to have the debt verified. They are not going by the rules.

    BBB         MORE INFO RECEIVED FROM THE CONSUMER : The Peak Capital will not send me any information regarding the debt they claim I owe. I even asked them what checking account the so called pay day loans went into and they could not provide me with any information. Payday loans are illegal in the state of Georgia. I asked them to send me validation of the debt and they never did. They did not send me a fraud packet. They cannot provide valid debt information per FCRA. They are obligated by law to provide this information which they refuse to do. I will be forced to take legal action against the company if they are not validation debts according to the FCRA regulation. 

 

Does anybody know what steps the BBB are going to take now? Can they make the company provide proof of the debt, which I know they do not have?

I am not overly fond of the BBB and the way they work.

 

I would also file complaints with the FTC and your states AG office.  You might possibly get better results there.

 

Send the CA an ITS letter informing them they have failed to validate the debt.

Thank you for that reply, I took your advice and just submitted an online complaint to the FTC, does anybody know how long it will take to get a response? I'm going  to also send the CS a letter as well. I hope all goes well because these two accounts are killing my credit score.

The FTC will not likely reply to your complaint.  They gather information then, if they have enough they can sue. 

 

Still file one with your AG.

 

I guess I am being dense but, what or who is the CS?

The company name is Peak Credit Services, LLC. They are located in Florida.
