Thoughts on OC investigation request letter

I disputed a couple of HSBC accounts listed on all 3 of my CRs. Both came back as verified and HSBC sent me a letter stating that each of these accounts were from two old Orchard accounts I used to have. After doing some research, I decided to send an investigation request to them. Here is the letter I sent. It went out CMRRR and I should have the green card back by the end of next week. Thoughts or experiences using a letter like this?

To Whom It May Concern:

I recently pulled my credit report from Experian, Equifax and TransUnion and noticed this account was listed on each of my reports as a collection/chargeoff. I immediately disputed this information with Experian, Equifax and TransUnion and the results of the investigation came back as "verified". I did not have an account with HSBC during this time period.

Since I have disputed the account with the credit bureaus, and you have verified them, I would like to see what sort of records you have for this alleged account. Under the new FACTA laws, you are required to conduct an investigation on this account, and I am now requesting it.

I will seek legal action under § FCRA 623 (b) for violations of the FCRA if you do not comply and respond to me with the results of the investigation whithin 30 days of your receipt of this letter.

In order to clear up this matter, I would like to see, a signed contract showing me that I indeed had an account with your company. If you don't respond with the results of the investigation (as is required per the FCRA), I will assume you have no documentation and therefore you were negligent in providing the credit bureaus with accurate information. At this point, you would also be in violation of the FCRA merely for not responding within the 30-day period.

To avoid a lawsuit, I request that you remove account from my credit report. Please delete this listing or I will be forced to seek legal action.

Well I sent it to an old gas company I KNOW doesn't have any proof I opened an account since it was in my EX's name, US Bank for a company CC that supposedly was a paid chargeoff and the 2 accounts from HSBC. Hopefully it will work on a couple of them and my report will get cleaner Smiley Happy. BTW only the company cc is paid and listed on my report that way.

If you plan on being able to use this letter you must dispute with the CRAs before you can. You will get your report squared away Happy just keep pluggin away.

This is GREAT - thanks!  I just disputed a couple (same account reporting twice), so we'll see what the OC has to say about that - the DOFD was 9/02 and they are reporting activity in 2003 & 2004 - what the hey!

Ok, let me get this straight.  Since the TL is listed as a collection through a CA, the OP asked for the investigation from them knowing that you never had an account with them, but with the OC aka Orchard Credit Cards.  Since HSBC never really held your account , they will not be able to find a contract signed for them.  Is that right?  Or am I way off base here?

There are 2 accounts listed on my CR from HSBC. I disputed both and they sent me a letter saying it was from an old Orchard Bank CC and verified to each CRA. So since these accounts are listed as charge offs and were verified by HSBC when I disputed, I sent this letter. Now I know there is no proof that I ever had these accounts and as such this letter is a way to force the OC listed on my report to remove the TLs or face litigation.

It is my understanding that quite a few people over on CB had similar situations and got things straight by using this letter. Once they respond saying that the TLs are being removed, I will have all the proof I will need if a CA tries to collect on anything from these accounts that aren't mine.

So, you really had no accounts with Orchard right?  The reason I ask is that I have a collection from a utility which I did use at one time, but it was for propane gas.  When I filled out the application, I was denied because my credit was so poor. I had COD the entire time I used them.  I do not understand how I can have a collection for $575 for gas that I had to pay for.  I'm not sure what was signed or not signed, but I know I couldn't have signed anything for a credit account.  I was thinking I would use your letter, but I was wondering if I should send to the CA?  Or to the OC?
