So, you really had no accounts with Orchard right? The reason I ask is that I have a collection from a utility which I did use at one time, but it was for propane gas. When I filled out the application, I was denied because my credit was so poor. I had COD the entire time I used them. I do not understand how I can have a collection for $575 for gas that I had to pay for. I'm not sure what was signed or not signed, but I know I couldn't have signed anything for a credit account. I was thinking I would use your letter, but I was wondering if I should send to the CA? Or to the OC?

If a CA is reporting the TL, you need to DV them. Then dispute the TL with any/all CRAs reporting it. Then they have to make the TL as disputed and stop collection activities until they do validate.

If it is the OC reporting the TL, then you need to dispute the TL with any/all CRAs reporting it. If it is validated, then you send a letter similar to mine.

Re: Thoughts on OC investigation request letter

It is the CA that is reporting.  I have already disputed before.  So, really you are describing the 1-2 punch?  CMRR a DV letter to CA, when green card comes back, dispute with CRA again?  Also, I have heard many discussions about DV'ing a CA after the 30 days is over.  I have known the collection was on there for a couple of years and disputed, but it always came back verified.  Have I given up my right to DV in the first place?

Re: Thoughts on OC investigation request letter

The CA is not under any obligation to validate if your request is not within the original 30 days. You can still send the DV request but it won't hold the same weight it would if it had come within 30 days of you noticing it.

Re: Thoughts on OC investigation request letter

Ok the 1st HSBC account was removed from TU as well but is still hanging on EQ.

The 2nd HSBC account is still there on all 3 CRAs as well.

I have yet to hear from US Bank but they signed for the CMRRR on 8-5 (Sunday? who gets mail on a Sunday) so there is still a couple weeks on that one.

Now the one that has me confused.....Nicor Gas. They responded with a form letter telling me the results of the investigation are they are reporting correctly. Now I know they are not required to send me anything more than this but there is no way they verified anything. I simply never signed, phoned, emailed, faxed or carrier pigeoned an application for service with them. What's my next step? I already disputed and it came back verified and now the letter.....Do I need to send an ITS or actually sue? Leaving it on my CRA isn't an option because I want to buy a house in the next few months and I REALLY don't want to pay $868 for service I never signed up for. Ideas?

Re: Thoughts on OC investigation request letter

OK....I got my responses from HSBC. 1 account is being deleted from all 3 reports. 1 they have records on but the letter they sent has a typo claiming I requested a CLI on the account on 12-10-07.....I guess they are psychic? I will talk to the lawyer about this when I follow up about Palisades since they claim to be collecting for HSBC.

I could still use some advice on the NICOR TL listed above.

I'm still waiting for US Bank's reply.

Re: Thoughts on OC investigation request letter

Well the HSBC account is still on my new EQ report.

Looks like the other HSBC TL is gonna stay but it's not showing any lates or anything just a CO.

Still could use some advice on the NICOR TL.

US Bank did not respond and we are now at day 31...waiting until day 35 before I send an ITS letter demanding the TL be removed.

To validate I request, name of OC, amount, and address and phone #. ALOS include complete documentation including signiture and complete account history.
If I do not receive complete validation within 30 days of receipt, I will be forced to turn this matter over to my attorney for futher action.

wait 1 week and MOV the CRA.....make sure that you put statue # AND  explain what it means.
