Trouble with the CA!!!

Hi everyone, I have an issue that needs advice. I had a collection with the library because the books were left behind when I went out of town. The books were returned but I still had this big fee that I was paying on, yet it still went to collections for one late payment. Okay, it is now paid in full and the library agreed to remove it from my files. The problem is with Unique Natn'l Collections. The account rep there will not agree to send it back and is feeding the library all kinds of junk. Unique also told the library that by law the CRA can not remove it and so forth. The account rep Melissa also told the library that I had a previous collection with Unique (violation of rights??) and the CRA will not likely remove it. The account csr told the library that they updated it and it reads PIF. It already did. Isn't it really none of Uniques business what goes on between me and the library? How do I get the account back to the library??? The librarian just doesn't know what to say and neither do I. Please advise.

Re: Trouble with the CA!!!

Here is the response sent by the CA to the library:

From: Melissa Fenton [mailto:mfenton@unique-mgmt.com]

Subject: RE: goodwill adjustment

Marian -

The name does not sound familiar and I definitely would not use the term "goodwill adjustment".  I just took a look at this account and it is paid in full and the credit bureaus have been updated.  I have scheduled a paid in full letter to be mailed as of today.  Hope this helps.  Thank you!

My response from the Library today:

Jai,

I spoke with Melissa again at Unique Management, and what she told me is that the credit reporting agencies won't make an adjustment unless there has been an error. She says that your account with us (and with Unique) now shows Paid In Full, and that the credit reporting agencies have been updated with that information; and that it takes about a year for the collection activity to come off your credit report.

I asked if I could help you by contacting the credit bureau directly, and she said the likelihood is low, because the collection agencies have contracts with the credit bureaus that prevent them from making adjustments except in the event of error. She also said that you have had other collection activity with Unique besides this most recent instance, and that that would make it difficult to persuade a credit bureau that an error had been made.

I am still willing to make a call to TransUnion for you, but Melissa was of the opinion that I couldn't do you much good that way. If you have a number that I can call, and still want me to, I'll be happy to do so. But since they already have the updated information, I'm not sure it will change their time table of when the collection activity drops off the reports.

Best regards,
Marian Kelly
Circulation Supervisor

Re: Trouble with the CA!!!

I would send a letter to the library lady stating that the CA outright lied to her. The report will stay on your report for 7 years ( copy & past the statue). Also advise her that you have no other collections listed . ONLY the furnisher can call the CRA BUT...If she can give you,on letterhead, that the CA is reporting incorrect info. and that you are not in collections, that might help.

Also state that a furnisher may delete anything that they want BUT what they do report must not be in accurate. BY deleting it does not come under inaccurate info.

Re: Trouble with the CA!!!

Dispute with the CRA as "creditor agreed to remove".

Re: Trouble with the CA!!!

How many more lives are going to be ruined by LIBRARY BOOKS!!!!!!!!!!!!!!!!!!!! I am so frustrated! I cannot get this mark off my EX report and it's killing me. The CA had my wrong address and every single notice they sent out to me was returned by the post office cause it was a bad address. I paid the library AS SOON as I saw my credit report. I am being punished for the CA's incompetence. Makes me NEVER want to go to a library ever again.
