US Bank Listing as CO instead of BK7 with a bal

On my experian credit report US Bank lists my auto lease as a charge off with a balance of $1624.  This was included in my BK7.   This was discharged in June 2007 and they are still reporting negative crap as of 9/07.  Shouldnt the last neg be 6/07 then?  Can they do this?  I need some tips on the best way to dispute this.  I'm doing the 30 day free trial thru Credit Expert, should I dispute thru them?  Or should I dispute with a letter to Experian.  TIA for your help and suggestions, Jerry

I'm definitely going to dispute, but I think sending my bankruptcy papers is way to much infomation.

You will spend several months trying to get it corrected. In the end you MUST prove to the CRA that it was included in BK. FTC says send  (copies) of all doc. to verify your claim. That is all that you are doing.

This only goes for CRAs.....never send any info. or copies of personal info. to anyone BUT CRAs.

A CRA has the right to ask for SS#...drivers license just to verify it is you. NO ONE ELSE CAN

If you have a fax   send that way........

I have creditors listed on my credit report that I filed bankruptcy on that have not reported the bankruptcy.  The minute I send my bankruptcy papers to EQ they will make sure they list every creditor as IIB.  I will do everything to avoid sending papers unless its a last resort.

Try contacting the creitor in writing explaining the account was IIB and they must update an stop repoting. Most will do this in the case of bankruptcy because to do otherwise would break the law. You can send a copy of the BK paperwork because if thye were included they should have received a copy in the beginning.

I agree with not supplying BK papers to a CRA, ***unless*** you cannot get your BK accounts listed properly otherwise. I have a different reason than you, however.... The CRAs will add "Chapter 7 bankruptcy" in the comment line of each BK account. This takes an otherwise neutral tradeline in your credit report to a negative.

Example....

I have 8 tradelines at CSC with a status of "Bankruptcy". In my MyFICO credit report's account list, 4 of these accounts have a red flag in the 'PAID LATE?' column (indicating it is hurting your score). These 4 all have "Chapter 7 bankruptcy" in the comment line.

The other 4 accounts have "NO" in the 'PAID LATE?' column instead of a red flag. These 4 accounts do not have the word "bankruptcy" in the comment line.

I'm certain the word "bankruptcy" in the comment line is the difference, as CSC is reporting ZERO late payments on me, per the "Credit At-A-Glance" page.

In my experience it is not unusual for all accounts that were incuded in Bankruptcy to state so on the comment line.

I'm having the same misgivings about sending all of my BK papers to the CRA.  If I do, then some of the accts listed as satisfactory will be changed to adverse due to being listed as IIB.

In my humble opinion, the idea of correcting your credit file is to obtain an accurate file. I am in a similar situation and I would want my file to be as accurate, good or bad, now as opposed to maybe 3 years down the line the all of sudden account that reported satisfactory now all of sudden change to IIB. It could make a big difference if you are on the verge of getting a loan or something else critical. I think its better to deal with the bad now, as opposed to worrying if its going to come back and haunt you at a later date. As far as sending your BK papers, maybe just start out disputing it and list the following: your name address ssn Court Name Case Number I believe(not sure maybe someone can correct if wrong) that if the Credit Reporting Agency needs more info from you they will ask for it. If they ask for your matrix of creditors or other schedules, I would send it as requested. Again, just my opinion and what I am doing for myself.
