Unauthorized Hard Inquiries

I need some help here. I checked my EX CR and noticed that I had two hard inquiries within 5 days of each other from Macy's and New York & Company. I did not seek credit with these companies but I did file complaints against them. The reason for the complaints were:

1. I had a Filene's account 8 years ago that went delinquent around that time. However, in 2007 this account dropped off of my CRs. One year later, I noticed that Macy's had reported the same account using DOFD as 3/2008 with a date to be removed as 8/2008. I disputed this but Macy's kept reporting it. So, I filed complaints with the proper authorities; and

2. I had a Lerner's account that went delinquent 7 years ago. It was due to drop off my CRs in May 2008. However, I noticed that New York & Company started reporting this account as well, using the same account number, CL, high balance, etc. I disputed it as being double reported but they kept confirming it. Nevertheless, I filed complaints against NY&C with the proper authorities as well.

So, I now noticed that they did hard inquiries after they were made aware of my complaints. They did delete both these accounts, but I am upset that they did hard inquiries instead of soft. I'm wondering if I should dispute them as I had no inquiries on my EX report and now it looks like I have two too many, and they were not authorized. Any suggestions?

Re: Unauthorized Hard Inquiries

That definitely sounds like no PP! You certainly weren't seeking credit with them. You could call and ask if they were aware that each one was good for a fine of $1000.

That's just ridiculous. It looks obviously punitive to me.

edit: just can't spell any more...

Re: Unauthorized Hard Inquiries

Whoa! Wait a minute. So you're telling me that unauthorized pulls of my CR is a $1000 fine per incident? Where did you get this information? If it is in fact correct, I will definitely get on this first thing tomorrow morning.

Re: Unauthorized Hard Inquiries

Yes, this is true.  $1k a pop if no PP.  Hauling is correct as usual.

Re: Unauthorized Hard Inquiries

Timothy's the expert on this one. He can cite you chapter and verse.

And it's not just hard inqs, it's soft as well. It's not putting the inq on your reports, which is bad enough, it's the invasion of privacy without permissible purpose.

I've now delivered the entirety of my knowledge on this one. Smiley Happy Good luck!
