Went to court yesterday and the judgement was Quashed.Smiley Happy They did not show up and the judge vacated it. They have already taken money out of 2 of my paychecks. I was told that LVNV is supposed to return the money to me after I send them a copy of the vacated order. Do you think I am going to have trouble getting 562.50 back?  What type of letter should I send telling them to give me my money back?  Can they take me back to court since they have my correct address now? On my credit report it is showing that LVNV is a factoring company, who should I send a dispute letter to, CRA or LVNV?

Yes, LVNV should return your money without problems.  A simple letter demanding the return of your money and a copy of the judge's order should suffice.  I'm not sure how fast they will do that or if they will cry and moan, but if you have problems you can obtain a judgment against them in small claims court.  Smiley Wink

 

Yes, they could take you to court if a) the judge didn't vacate the judgment with prejudice or b) the statute of limitations hasn't expired on the debt.
