Wells Fargo is refusing to remove re-inserted negative info. What is my next step.

In the past I had some late payments post from Wells fargo auto, and they were disputed and accurately removed in 2007 From Equifax. When they switched thier account numbers things went haywire.The information was recently re-inserted after I asked Equifax to remove the statement that said I disputed the account, and update the balance to $0. The only reason I messed with this account was because a loan officer I was dealing with asked was the account in dispute or closed or what. Equifax went and bothered Wells Fargo, and all I wanted was the dispute statement removed. Couldn't Equ have done that without sending a dispute to WF. Now Equ will not remove the late payments. So now I sent a letter to WF and Eqifax asking how could they re-insert info that had been disputed and deleted in 2007. WF responded by saying that the info they were reporting is accurate. What now? If they want to stick to thier guns and say that the info is correct now, doesn't that mean that they have been reporting inaccurate info since 2007 while they were not reporting any late payments at first. I was wondering if I could use an intent to sue, or should I go to state AG or do I have a complaint or what. Please Help.

Do you have proof that the late payments were removed due to a dispute prior to this?

 

Are the lates legit?

Yes I have the proof, one good thing is that I have all of my past credit reports dating back to 2006. I also have the original dispute letter that I sent to WF and their respond letter saying that they would correctly update my credit files. I sent that letter to Equ along with my old credit reports showing no late payments after I disputed in 2007. The account was reporting correctly until recently, but I don't think EQU even bothered to read of any the information that I sent in. More importantly the account is closed and paid and WF could probably care less about helping me correct this issue now that they have been paid in full. EQU just keep responding to the disputes by saying this account does belong to you, and is being reported correctly. As long as WF is verfying that I own the account I do not think EQU is going beyond verifying the ownership.

If possible, ask WF to provide a copy of the statements around the time or if you could get your bank records (cancled check?)

No, the lates are not legit and that is why they removed the negative information in the past. I have just noticed the WF is reporting the payment history from an old account number under this current account. This current account has never had any late payments. My old account with them had some late payments but those dropped off and were no longer reporting. All of a sudden when I asked them to update my current account to a $0 balance/closed, then they inserted the negative payment history from the old account number. I just recieved a print out from them with my payment history data, and that is how I discovered what they are doing. The printout is 2 pages for the 2 different accounts. For example Acct#1 is acct#50236455616991 which is the new account and has no late payments on file, but acct#2 acct#45675 the old account, does have late payments. They are apparently reporting the late payments for account #2 under account#1 payment's history even though the accounts have 2 different account numbers and they are reporting the late payments under the new acct number which has no late payments on file. Can they do that? They had removed the old account entirely from my credit file when I informed them that they were duoble reporting the accounts, and it made it look like I had 2 open account with them.  They were willing to help when I was still a paying customer, but now they have not been very responsive. There was never any late payments on acccount#2 and I would think that they are supposed to report as such.

I would first try to get them to correct.

 

If they won't and you have a print out with the same account # as what is reported on your CR showing no lates, then I would submit that to the CRA with a dispute. Cite the section of FCRA where the CRA is to consider information/proof the consumer provides.

 

If that doesn't work, complain to the BBB, your AG, and any regulatory agencies they are under.

 

If that doesn't work and you are willing to go through with it, consider a ITS letter.
