What Do You Guys Think?

Ok, i received a letter from the company RJM Acquisitions about an overdrawn WAMU account, i did a debt validation request letter, I got a response a few days ago, apparently someone opened up an account on the internet in my name because WAMU sent them account statements as proof. The account is over drawn by 956. I just found out the person who did this, (a relative of course). The relative agreed to take responsible for the account, or else I'm pressing charges. I called RJM and spoke with the supervisor and told them about the situation but unfortunately since the account in my name I'm the one who is held liable, (what kind of crock is that). So the supervisor said what i can do for you is give you a settlement of 450, and  you can pay 25 a month until the account is paid off, and as long as you are making the payments it will NOT report on your credit, I will even send it in writing. I told  him i would call him back, to give him my decision. Now my relative has agreed to give me 250 this friday and can give me 200 the next payperiod to clear up the account, and has agreed to put this in writing.

Should I trust this, because im scared that if i do not do anything it will end up on my credit report? I have been working so hard with my credit and a collection account will tear me up.
Please help?

Re: What Do You Guys Think?

Hold up-

To start with Do not call RJM- everything in writing
Are they reporting?

RJM is a junk debt buyer/collector- They will tell you ANYTHING to get you to pay.

Start with an ftc affidavit of fraud

Send it to the CRA's and RJM CMRRR allong with a dispute-

Read the FCRA sections on ID theft-

You accepting his payment will likly RELEASE him of any criminal or punitive damages-

You also want to check you CHEXSYSTEMS report-

Don't tell RJM you know who commited the fraud!!!

Re: What Do You Guys Think?

No, its not on my credit report, because when i first got the letter the next day i did a debt validation, the account was opened in August 2006, and the relative was living with me at the time.

I have an ID Fraud alert already on my credit report, I checked my chexsystems report and it is not listed on the report (thank goodness).  Now, I'm at a stand still, I know the person who did it, they agreed to pay for the account, What do I need to do? I don't want it hit my credit report, so I'm afraid if I don't do anything they are going to list it on there since they sent the statements from WAMU as proof of the debt.

Re: What Do You Guys Think?

Have them send you the agreement to not report in writing and keep copies/records of all payments you make.  I had a small collection with them last year and they never reported, as promised, but it was small enough to just pay it all at once.

Re: What Do You Guys Think?

That's what the supervisor said, the told me that he will send me a letter in writing that they will not report as long as the payments are being made. Thanks, you gave me a relief knowing that they do keep their word. I will send them the payment, and get the money back from my relative, but first I'm writing a letter of agreement to pay, and get it notarized, and if they break the agreement I'm taking them to court.....

Thank you guys for all your info and advice, I have been working too hard on my credit report.

Re: What Do You Guys Think?

From personal experience with RJM Aquisitions..I think you can trust them...I settle with themand paid them on April 3rd and asked for a deletion from the CRA's...and it was done no problem...she said they delete if the customers asks them too...no problem...then I received the letter about the deletion a few days ago...their a good CA...not a corrupt one...
