What's diff between "assigned" and "purchased" debts?

I have wondered for a long time what is the difference between a collection agency that claims the debt was "assigned" to them versus one that says the debt has been purchased.

I know for certain that when it is assigned, one can "fire" the collection agency and return the debt to the original creditor.  But can that technique work when a collector claims to have purchased the debt?

I hate dealing with these dogs.  I would much rather pay my money to the company that originally gave me the credit.

After a dark period in my life of receiving threatening calls from 8am to 9pm, and sometimes after 9pm, at work and at home, I finally learned my rights.  What a pleasure to just hang up on them and know I have every right to do it.  One can even say, "I don't know what you are talking about.  Please send written correspondence and I'll look at it."  then hang up.  Reclaim your life.

Re: What's diff between "assigned" and "purchased" debts?

If an OC assigned an account to a CA, they "hired" the CA to collect on their behalf. The CA is their agent....employee if you will.

If the CA purchased the account from the OC, then the CA actually paid money(consideration), FOR the account. The OC relinquishes all rights on the accounts to the CA. The OC is totally out of the picture. If the CA receives payment on the account, the OC receives nothing. It all goes to the CA.

Re: What's diff between "assigned" and "purchased" debts?

If an OC can't find any info about the acct that has been CO, then would you assume the CA has purchased the debt? And is there a way to actually find out from the CA if they own it or just assigned to it in a letter or something?

I wouldn't make that assumption. I would think an OC retains all account info on someone for a LONG time. Even if it was sold to a CA. Not that that is my opinion only.

You should DV the CA. Make them prove their case. ESPECIALLY if you can't remember.

Have any particulars you want to share?

IMO you should DV the CA, and have them prove their case.

Maybe others will chime in with their recommendations.

I agree if it's a question of who owns the account then DV whoever is reporting to your CR, there should be an address for each creditor on your CR.

Re: What's diff between "assigned" and "purchased" debts?

If the OC is not on your CR, then imo, you cannot justify DV'ing them.

A DV is a debt validation. It makes the CA prove that you actually owe the debt.

If you know who the OC is and they have no record of your acct. at all, then something must be going on.

That would send up red flags to me, if it were mine. Who is the OC and CA? And the amounts? How old?
