What should i do with this ?

i just found out last 2 weeks that i have a new medical collection account in my EXP credit report . Smiley Surprisedit was from 06/2003,and it says that it is belong to me ex eife,
where we been divorced for almost 4 years,and also i had filed for BK on10-15-05 
and this is what it show on my credit file after i disputed twice .
Account # 12xxxxx
Status :   No status
Report Date ; 06/2003 
HIgh Balance: N/A 
Monthly Payment: N/A
Recent Balance: N/A
Last Reporting Date: N/A
 
So what sould i do next,and thanks  for your help . Smiley Happy

You can try contact the OC and see if they will remove your name from the account.
 
If that doesn't work, check out whychat hipaa.

also what do you think if i DV this acc where it says NO STATUS ?

OC= Original Creditor............call the doctor's office or hospital where services were rendered and ask for your name to be removed from the account.
 
What do you mean DV the "no status"?  A DV is something you send to the CA asking them to validate the debt.
 
Since this is medical, you may have more luck using whychat's hipaa method. You can google it and find it.

If you BKed, legally, it was included in the BK even if you did not list it at the time. When you BK, all debts (excluding unpaid taxes, student loans, alimony, child support, etc) are forgiven!

Send the reporting creditor/agency a letter stating that you've discharged all debts in Bk and include the filing date, and case number. Also, for best results, include your Discharge Order.

That really should take care of it.

Thanks Wonderin--- no experience with BK. Here I thought you could leave accounts out of BK if you wished. I hear people saying "I included this" or " I didn't include this" , wasn't sure.

You CAN, but they have to be "reaffirmed" ... essentially, as I understand it, you have to ask permission from the creditor to let you rehabilitate (for lack of a better term) the debt. Sort of almost like getting a new loan (but not quite).

What I think it has to do with is the faith the creditor has that you will pay your bill and not default on the debt completely (since 7's don't eliminate the debt completely, they just pay off a large portion). I think it's sort of like "If you BK and I DON'T let you reaffirm the debt, I'll get my $$ now -- albeit, less than what I'm owed." VS "I'll let you continue to pay me as before and hope to goodness that I'll see a single penny!"

At least, that's how I understand it.

As to including debt in BK, a creditor CAN come after you for any debt not OFFICIALLY discharged in BK, however it's so easy for a debtor to "roll" the debt in that it doesn't seem to be worth it, AFAIK. Also, the wording of BK law (Federal, of course) is so hinky that in one sentence it allows them to come after you and in the next, it doesn't.

Sort of like: "From now on, John Debtor's debts are ALL forgiven, except what was not included in the BK. However, if you go after John Debtor after discharging, due to the fact that you should have gotten up off your patootie and nailed him then, I'm going to spank you with a rolled up newspaper, because ALL of his debts were forgiven."

You know ... the kind of intelligence and straightforwardness we're used to seeing from our gov! Smiley Wink
