Who should I contact?

Hello all! I have been lurking for a couple of days and did a couple of searches, but I wanted to get some opinions on my situation. It is a little long and I am brand new to all this, please bear with me.

A couple of months ago, I received a letter in the mail from CBCS saying that I had a past due account that had been placed with that office for payment. They listed their client as Pinnacle Credit Services. I had no idea what this was about and did enough research to find out that CBCS and Pinnacle were both collection agencies. Talked to a friend, they told me to send what I now realize is a debt validation letter and gave me a form letter to personalize. Did that, sent it to CBCS and received a letter back from CBCS saying that they have stopped collecting on the debt.

Fast forward another month, I thought hey I really should check my credit report (never done it before). On my report it shows Pinnacle as a buying the debt from Verizon in 2005 even though it apparently went bad in 2001. I am technically responsible for the debt (when I was young [read: stupid] I signed off on a phone contract for a family member) I have never been contacted about this from Verizon or Pinnacle, not even since the thing with CBCS. I am within the statue of limitations until 2011 and I would really like to just pay this off (and not get sued!)

My question is, how do I go about it? Do DV with Pinnacle even though I know it is my debt? Do I try to contact Verizon instead or do they have nothing to do with this now? Why/how did CBCS try to collect? (I am just happy they do not show up on my report too!) I read that Pinnacle is nasty, I just want to go about this in away that they are happy, I get this off my reports, and I do not get sued! Thanks in advance!

Re: Who should I contact?

Hi, tucker, welcome to the forums, and welcome to the adventures of Firefox users. You have just met the Dreaded Firefox Paragraph Blob.

When you post, there is a check box at the bottom left that says "Automatically convert carriage returns to HTML line breaks." That's your paragraph saver. Always make sure that it's checked.

For your original post, click "Options" at the top right, and then select "Edit message." It will re-open in the text box again in a somewhat terrifying html format. First click that box at the bottom again. Then, to re-insert your paragraphs, look for where it says (div)(/div), except that it won't be paragraph signs, it will be < >. Click enter between the two pairs wherever you see them, and then click "Preview Post" at the bottom right to make sure that everything is back where it should be.

Anyway, if you'll plunk those paragraphs back in, you should be able to get some help.

Re: Who should I contact?

I use Safari (Mac) and have this same problem. I don't know why they don't add checked="checked" to the checkbox so it will always convert line breaks to paragraphs by default. I hate having to remember to check that stupid box over and over.

I guess myFICO cannot do this though, since it appears they are using a hosted solution for the forums (Lithium). This forum software needs to be upgraded for use in the 21st century. Or they could always just convert to using vBulletin, which is my favorite.

Re: Who should I contact?

Hi tucker2  welcome to the forum.  First you are confusing CRTP with SOL

This link has all the abbrevs that we use and the freq.requestion threads that are full of info.

CRTP v SOL

Look for your state    simple SOL

To begin with  both are CAs (collection agencies)  they can not both report at the same time.

If both are reporting   dispute the first one (the one that sold it)  not mine

If you have not sent the DV to the OWNER of the debt  do so now  CMRRR (owner would be the CA that bought the account)

You are past SOL!!!!    Never talk to a CA  everything in writting!!! and never sign anything to a CA  just type your name.

Also do not worry about being sued.....federal law states on cell phones.....must file suit within 2 years of DOFD or DOLA    that would be the 2001 date!

The CA must answer the DV within 30 days or stop all collections (reporting).

IF after 30 days & no answer ans it is still on your CR    file a dispute with all CRAs that are reporting (dispute as *not mine*)

Re: Who should I contact?

HappyDays: I thought cell phones were considered written contracts and in my state written contracts have a SOL of 10 years... is that incorrect?

Re: Who should I contact?

federal law  not state SOL   I do not know if this covers other phones  but it does CELL phones

§ 415. Limitations of actions

(a) Recovery of charges by carrier
All actions at law by carriers for recovery of their lawful charges, or any part thereof, shall be begun within two years from the time the cause of action accrues, and not after.

Also when you look at the simple SOL  it has ---open contracts   promissary notes....these are for comsumers

signed contracts and oral contracts  ar almost always for busness
