Why I hate Equifax

I've been working for the past year to get a negative trade line removed from my credit report, Equifax has been a nightmare.

Two entries showed up on my credit report about a year ago for a Cell Phone bill for $95 listed as a charge off for $95 and also as a settled collection paid for less than full amount. This entry was not mine, had nothing to do with me other than the same last name on an inactive account. I disputed the two trade lines through Equifax, they came back "verified" (thanks so much e-Oscar), I requested a reinvestigation, also returned as verified and reported correctly. I wrote two letters to the cell phone company (each trade line had a different address) in August, a polite but somewhat demanding letter - crickets, no answer.

As a final attempt to correct this issue, prior to filing a small claim lawsuit, I filed a BBB complaint against the cell phone company. It took a while, but the cell phone company was responsive and agreed that the trade lines were being reported in error. Beginning of November 2011, the cell phone company notified all three CRA's of the error and to remove the trade lines. Trans Union and Experian quickly corrected their (my) reports, Equifax did nothing.

In late November I notified Equifax that the two trade lines should have been removed, Equifax opened another "dispute". November 29th Equifax returned a result of the dispute with both trade lines marked "deleted", but they only deleted 1 from my report and left the one that said "Charge Off $95". I notified Equifax that they should have deleted both trade lines and referred them back to their results from the previous dispute. You guessed right, Equifax opened yet another dispute and 4 weeks later returned a result of "account verified as correct" (not to be deleted).

After the last (4th) dispute I wrote back to my contact at the cell phone company which stated that November 7th they had sent the delete, November 22 in response to a dispute from Equifax they again requested the account deleted AND again today in response to my letter again they were notifying Equifax to delete the incorrect trade line. The Cell Phone Company also said there was nothing else they could do but were sending me a letter stating that the account trade line was in error and to feel free to show it to any creditor, etc.

As of December 30th, Equifax had not removed the trade line so I sent a letter to Equifax listing everything and including the letters from the cell phone company, both the one showing 3 attempts to delete the trade line and the one that I should show to creditors stating the listing was in error and should be deleted. Again, a polite but firm letter was sent to Equifax that included the fact that I would file a lawsuit in Jan 2012 (FCRA, etc) if they did not correct the listing. Result? Crickets, no answer no response and as of 1/12/2012 the trade line remained.

This was a slam dunk case for small claims court including costs and possible damages, but I really was not interested in dragging it out for another year. I filed a BBB complaint against Equifax and basically just pasted the letter I sent them at the end of December as my complaint. On the 19th of January, Equifax responded to my BBB complaint with a statement that the trade line would be deleted, on the 20th it was. End of story? nah....

On the 20th of January Equifax also deleted 20 other trade lines, all positive ones including my 34 year old Macy's (still open, $0 balance) account, resulting in a 41 point drop in my FICO score. Now before you say that was just simple maintenance, Trans Union shows me with 43 trade lines, Experian shows me with 41 trade lines, Equifax shows me with only 20 and those accounts that I held jointly with my wife (Macy's, car loans, paid off mortgage on a second home, etc) are still showing on my wife's report, just not mine. I paid for credit pulls from all CRA's as of the 21st and my Trans Union FICO score has not dropped either.

What is the possibility that 20 different trade lines would "expire" on the same day for me but not my wife? Retaliation for filing the BBB complaint or just continued incompetence by Equifax?

Re: Why I hate Equifax

Wow, that sounds like a horror story with what you went through with EQ!!

Sorry to hear about that, in regards to the 20 TL's EQ deleted, you mentioned one (Macy's I believe it was) was still an opened acct with a 0 bal, what about the rest of them, were they closed accounts and hit the 10 yr mark?

Yes, I do find it odd that ALL 20 accounts hit the 10 yr mark all on the same day, it seems as if EQ might be trying to get even (so to speak) however, if that is the case, I would think EQ would need to fix that ASAP or you could take action against them.

This is not my area of expertise (if I have one) hopefully RobertEG will see this post, if anyone here can provide you with comprehensive information, it would be him, there are many others that have superior knowledge, the first person I though of was RobertEG.

I'm Wishing you the Best of Luck getting this all worked out.

I had a similar experience with Equifax.  Initiated a dispute.  The 'disputed' items came back as verified but three closed positive tradelines were deleted.  They were closed for about 18 months and should have remained but, they deleted.  I called but nothing was done to put them back on the report.  My score dropped 15 points as a result.

TARGET: 800

2/5/12: EQ: 749, TU: 739

You may have the last laugh....

If the tradelines are active, with the creditor still reporting monthly, then the tradelines will magically reappear!

Sorry that they are being difficult.  TU is the horrible one for me - and they use to be sooo nice!

Paid off car loans, mortgages and closed credit cards mostly, all were positive trade lines. With the exception of Marcy's, all were closed accounts. Funny though, they are still on my TU, EX reports and those (most were) held jointly with my wife are still on her EQ report. AAoA went from over 10 years to just over 4, which is how I noticed it because my report now says "short credit history" - really?

Oh man, that would have me infuriated, I'm not sure what can be done to fix this, if anything?

Out out curiosity, were these closed accounts nearing the 10 yr mark of being closed?

I'm so sorry to hear about this pipeguy, what a bummer.

ETA: the Macy's will most likely pop back up a few days after it's statement cuts.

I'd have to go over the before (1.17.12) and after (1.20.12) print outs line by line to be sure, but it looks like the accounts were all DoLA 2003 to 2007.

Funny thing is, in November I disputed a 30 day late showing up on my Lowes account from May 2007 (EQ once again) because I don't believe I ever paid Lowes late and Lowes agreed which deleted it from my EQ credit report (but not from my wife's EQ, jointly held). Since November I have reduced my Lowes balance by 75% and I was also granted a CLI from Lowes that doubled my CL. Both the new CL and the correct "reduced" balance is reported on my wife's EQ report, but my report from EQ still shows 11/2011 as DoLA with the higher balance and lower CL (TU and EX show everything correctly).

I don't know what's going on at Equifax, but I must have PO'd someone over there.....

It would seem EQ has it out for you.

I'm surprised the Lowes account has not been updated, since I'm sure they are still sending monthly updates to EQ.

What a nightmare EQ has been for you, I surely hope they get their crap together and stop messing with you.

Re: Why I hate Equifax

The deletion of old trade lines from your credit file due to aging is strictly a CRA administrative decision, and is not controlled under the FCRA.

They delete to purge their files, for their convenience.  Their 10-yr from closing practice is, in my opinion, far too short.  It ignores the negative impact on consumer scoring by loss of the most senior accounts, and additionally deprives creditors of a complete file history.  Another area for FCRA revision?

The CRAs would argue that after 10 years from closing, none of the CR exclusion period dates are longer material (ignoring tax liens, which if unpaid have no CR exlcusion date, or BKs, which can extend beyond 10 years from closing date), and thus they no longer have a monitoring responsibility.  They apparently dont care about impact on consumer credit scores.  Creditors apparently are not complaining, so consumer impact is secondary.

It is particularly troublesome due to the arbitary admin of this practice.  I recently had an old, closed acct that was not deleted until more than 18 years from its closing.

While I, of course, did not complain while it was still included, others see deletions at 10 years, so the impact on consumers is inconsistent and arbitrary.
