Will disputing a collection with the CRA alert the CA?

My fiance has a couple collections on his reports that appear twice. I was wondering, will disputing the accounts as duplicates wake up the CA and cause them to try and collect again? We would like to have the duplicates removed, but we don't want to remind the CA that we're here Smiley Tongue

btw... I hope that all made sense, I'm still new to all the acronyms here Smiley Happy lol, I thought we had a lot in the insurance industry...

Yes!!  When a dispute is filed with the CRAs they notify the company reporting.

So then it'd be better to leave the duplicates alone rather than bring the attention of the CA to us? Some of them are past the 4 year texas SOL, can we safely dispute those without worrying about the CA's?

You say they are reporting twice.  You need to get a 'Hard Copy' of your credit report from all three bureaus.  This will provide additional detail not available on online pulls.

 

Is the duplicate Trade Lines (TL), reporting from the same Collection Agency (CA), or a different one?  If it's two different CA's you should be able to dispute the older one off your report since they have probably sold the acct. to another CA.  And since CA's do not routinely communicate that kind of information among themselves, a dispute to the CA who no longer holds the acct. should not alert the one who does.

 

Is one of the TL's being reported by the Original Creditor (OC)?  If so, it should be showing a 0 (zero) balance since the OC will have charged the debt off before sending it to the collector.  OC's are allowed to report, even if they no longer own the debt but the reporting must be accurate.

 

In fact, you may have as many as 3 (three) TL's legally reporting the same debt.  One from the OC, one from a CA and one additional TL if the debt has been reduced to judgment. But, the TL's must be accurate.

 

If you decide to dispute, target the specific line items that are inaccurate or in the case of duplicate reports by different CA's, just dispute the earliest one as 'Not Mine".  If it's verified accurate you may have a violation under the FCRA and FDCPA (Google those two if you don't recognize the acronym).
