can they do that?

I received a notice from myfico saying I had a new inquiry on my report, knowing I have not applied for new credit ect. I buy the report to find out who it was.  It was our local bank.  Here is the situation.  I have a checking account with them(5 yrs).  We have a house loan with them (3 yrs), but it is under my husband.  I still believe I am listed on the house note but not as a person responsible for payment ect, just because Im his wife.  Payments are current on house.  Can they do a hard inquiry like they did, is that legal?

First thing is check with DH to make sure he did not apply for anything.

If you did not apply for credit and have no revolving acct with them- they do not have PP to pull a hard on you.

DH has also not applied for anything with them.  So is it revolving accounts that have a right to pull whenever, not just a regular loan?

No, it's asking for credit of any kind --installment loan, credit card, line of credit-- that creates PP (permissible purpose). A lot of banks have decided that they have the right to hard you when you open a checking or savings account (they don't, though.) But I've never heard of one doing it to an existing customer.

Since you have a mortgage with them, it would be OK for them to soft you, as you have an existing credit relationship, and this would fall under account maintenance. But if it shows up through SW, it's a hard.

So since we did not ask for credit they have no right for a hard pull. That is what I thought.
