debt collection

I had a debt collector call and woke me up saying if I didn't pay this bill now they will serve me with a judgment. So I have a fha loan in the works, so he said they would settle. It scared me about screwing up my mortgage. Come to find out later the bill in guesting had been paid 14 yrs ago. But I had already settled on the phone, not wanting a judgment. I told them it was not legal to do that and I wanted my money back, could not find the receipt showing paid, they said by me agreeing to pay that reset SofL and it was legal. Anyone know if I am just out of luck with this?

That is why we have courts.

Sue their butts off.

Clear debt collection practices violations under the FDCPA, including threatenint to take an action not authorized, misrepresentation of a debt, false representtion of legal action... along with a few others.

 

I would consult an attorney and sue for invalid contract based on their violations, and damaages under the FDCPA.

That's what I thought. I have spoke to them and ask them to give money back or I will get a lawyer and they said to go ahead that they are in there legal right. That is when I began to use some choice words about there practices. Don't know what lawyer to call about this.

I suggest you review FDCPA 806-808 for a listing of unfair and prohibited practices thst could form the basis for civil action.

You may also consider a formal complaint to the CFPB in addition or alternative to civil action.
