disputing "too old"

I have a couple of items on my credit report, that are still reporting, but should have dropped off 1-2 years ago.  1 is from MBNA, which is showing 3 times, 1 from BOA (which bought out mbna), and the other 2 from the collection agency credigy.  i've already disputed this item, but came back verified.  i diputed as not mine, because i thought that during the process, they would realize that it was too old anyways, and it would be deleted.  (when i was fairly new to the disputed process- i guess never assume)  anyways, the date of deletion is may 2008, which is only 5 months away, but i don't know if i should just wait out the 5 months, or how i can dispute this item as "too old".  i don't have any proof (don't really know what kind of proof i could use to show that it is too old)  i do have a previous credit report, that shows a date of deletion of 2007.  however, this is an equifax report from 2006.  so, i'm assuming i can use this as proof for equifax, but i'm sure i can't fax it to experion or tu. so, my question is, how do i dispute an item as too old?  my other issue is that i have several medical bills that are showing on my credit report, from 1999.  i've tried the pfd letters, but i got a response, that the CA doesnt own the accounts, but are simply collecting for the hospital, and that they are willing to accept the full amount of money, but will not delete.  so, since they don't own the accounts, should i attempt to pay the hospital? or how do i report this also as "too old", since it is from over 8 years (almost 9) ago?  the date for deletion shows 2012 on my CR, and it has a date of assignment of 2005.  Any assistance will help.  Thank you.

What made you think that the BOA would drop 1-2 years ago?

Re: disputing "too old"

I'll try-

MBNA- when you disputed they changed the DOFD or DOLA this caused the removal date to move. - look at the exact lates listed and find the first 90 or 120 late- this is DOFD. Add 7 years to this date.

What the CA is doing is illegal- they need to use the DOFD (date of service on medical) provided by the OC.

You have 2 ways of handling this-
1. Keep sending stuff back and forth to them (keeping impeccable records) whaen the number of FDCPA violations sue em for 10K.

or

2. Send them an Intent to Sue letter for "willful noncompliance" and FDCPA violations as the alleged debt was incurred on XX/XX/XXXX

Re: disputing "too old"

I haven't called the CA.  I already DV, with the credit bureau, and it came back verified, and BOA (originally MBNA) should have dropped this year or 2006, because the DOFD was 1999.  Went to collections in spring 2000. How do I dispute with the CB, with "too old" obsolete as the reason? or better yet, how do i word it? i've tried DV with CB, but it just keeps coming back verified, i think i'm using the wrong reason code however.  or should I DV with the CA?  thank you.

Re: disputing "too old"

As Timothy said * you DO NOT   DV the CRAs *    you dispute with the CRA  which is what you did.

You DV only a CA!!

My advice to every one is also *Never PFD* without a DV first!
