national credit solutions????

i have a bogus collection on my EX CR from national credit solutions with the OC being BMG for $158.00.  Im just wondering if anyone else has had any luck getting this company deleted???  I sent a DV letter to them and i got the green card bk in the mail saying they had signed for it on the 1st of june and the VERY SAME DAY I got a  letter in the mail from them saying i had 30 days to validate or they would assume it was my debt.  So..All in the same day i sent them another dv letter cmrrr and i got the card bk on it yesterday saying they signed for it on the 8th of june. YES!!! It was a very busy day!!! LOL!!!  Now Im waiting!!!!!

I too have the same company and with BMG. Never had a BMG account atleast the last 7 years. I also just had my Bankrptcy discharged, Is this another scam?

I too have this on my report. In my case it turned out that it is not BMG as it says on my report but some Columbia House DVD club going back to 2003. Say I owe 200 on a 9.95 DVD. I don't recall owing anything but being that far back I don't have any proof otherwise.

It took me getting the Attorney General in their homestate of business invloved, along with the FTC and a court summons delevered to their office for them to shake enough to know that I meant business.  I sued 2 bogus collection agencies in Jan for 5000 each and won for various FCRA and FDCPA violations.  Don't let them push you around.  For mine: BMG music came back as saying the account was opened at an address that I never resided.  Work em over and push back hard.  I believe this is a HUGE scam by BMG Music, Columbia House and National Credit Solutions.  I travelled down to their office to chat with them during my ordeal and was met by a bunch of 18-20 year old brats answering phones.  I witnessed them speaing hatily to customers, threatening customers...all within earshot and I had a voice recorder.  Showd it to them and they listened to me.  I am an extremist when myself or my famiy's money, credit, well being, etc... are threatened.  Don't know if anyone else would go this far, but I love pushing back hard when I know I am right.  Hope this helps.  Best of luck with these retard collection companies.

They did the same to me a few months ago. It was listed as BMG but also turned out to be a Columbia House DVD service I did have, nor owe money to.  I threatened then via snail mail and email that if they did not have the item removed from my credit reports with 7 business days, I would take them to court. Got a return letter stating that due to a possible discrepancy they were removing the item from my reports and sending the account back to their client. I think it's a crock of crap, whatever they are doing. The item was removed from my reports.

Information on National Credit Solutions 

 

If you see that an agency has reported something to your credit report this means that the account has been overdue for an extended amount of time and the original creditor has transferred your uncollected debt to collections. In  most cases someone had to provide two types of identification and legitimate credit card or payment information for these original transactions... ( does not apply to mail/internet orders) but whether it was you ordering from a company a long time ago and you just can't remember OR it was someone with your information ordering the merchandise EITHER WAY the order is under your name because of the information that was provided. If you submit a WRITTEN request for validation the agency should supply that to you no problem at all ( they have 30 days to get it to you)

You may or may not have been contacted by the original creditor for attempts to receive payment before they handed over the account to a 3rd party collections agency. It stinks to find something on your credit report without any warning HOWEVER once the account is handed down to a collections agency they have the right to report it to the Credit Bureau without notification (With the exceptions of 3 states).

After the agency receives contact from you or contacts you personally, 5 days from this initial contact you will receive a letter stating your rights and the amount owed. If they don't hear back from you it is assumed that you have received the notice.

After receiving this first notification you have 30 days to send in a formal written request for validation. After 30 days they are not legally obligated to send you a validation but may or may not as a common courtesy.

It is very important to resolve any issues with collections agencies in order to avoid increasing fees and to maintain a good credit score. Some people might say don’t pay, reporting to your credit is just a bullying tactic. This is bad advice because the longer you wait to pay your debt the more fees build and your credit worsens. In extreme cases your credit card may be cancelled, you may be refused a loan or unable to make any serious purchases.

Full payment, payment plan, settlement?

There is a difference in each of these options and how it affects your credit report. Also keep in mind that the quicker you resolve your debts with the agency the better -- as the account sits in the system it accumulates interest fees and becomes more and more expensive with time. Stay calm and make an informed decision, but do not blow your payment off. This only costs you more in the long run.

Full Payment- quickest, guarantees that your credit will be cleared

Payment Plan –You can establish a payment plan over an extended period of time based on how much you are financially able to pay. This process takes longer to clear your credit but eventually does. They can set up automatic withdrawals according to the payment plan you have established.

Hardship Settlement- On a case by case basis you may or may not qualify for a hardship settlement after they assess your situation and financial standing. Different factors affect their ability to settle such as ownership of the account and what type of account it is. If you chose this option your credit report will show that you settled for less than the legal amount owed. They can't guarantee the degree to which your credit will improve it varies in each situation.


After I pay how long will it take to get it off my credit?

One agency that I have dealt with, National Credit Solutions, reports to the Credit Bureau with any updates to your credit every Friday. (but I assume this is different for every agency, so go ahead and ask) The CA will notify the Credit Bureau but after that it is their obligation to make any changes as they see fit. The time that it takes to see any immediate results or removal varies.
 Other Options: Cease & Desist/ Dispute

Cease and Desist is a formally written request. Be advised, cease and desist does not make debt go away. Requesting cease and desist will simply terminate any written or verbal communication towards you. However, the debt will still show up on the consumers credit report, the account is still open, and the individual is still held accountable for the debt. But don't send a cease and desist and ask for verification...that doesn't make sense.

If you are disputing the debt it is best to file your dispute through Transunion.com or experian.com, or mail it directly to their office.
 If you feel that the debt being pursued is not yours and you have legitimate proof to clear the account from your name then you should file a dispute. After they receive a dispute an investigation is taken up that lasts 30 days. After this 30 day period they have 30 days to contact you. This takes time.
IF YOU ARE FILING A DISPUTE KEEP IN MIND:
1.) You must provide proof.
2.) After a dispute is received by NCS they commence an investigation that can take up to 30 days.

If for example you are disputing the debt on the grounds of identity theft you must provide a police report and the identity theft affidavit for that relevant period of time when the debt occurred. Another example would be a person who was overseas at the time of the transaction, if the correct documents were submitted to prove this the account would be closed.

With millions of accounts there are bound to be mistakes or cases of fraud HOWEVER many people claim identity theft with no proof in an attempt to get out of paying.

If you don’t think the debt is yours do not file a complaint submit a dispute! Complaints should be very rare. File a complaint if you are reporting any harassment or if the agency has broken the law.

Some great advice here...BUT.....(DRUM ROLL AGAIN...)....National Credit Solutions has a proven track record for NOT doing any of this on their end.  Take it from me.  I run a consumer website dedicated to consumer rights and protection.  NCS is the top reported company to us and other for abuse of collections laws, FDCPA, FCRA and other state and federal laws.  One lady actually threatened to send someone to "take care of me" if I did not pay yelling at me.  I am clear of baddies on my CR now and am glad, but am trying to help others that are where I have come from.  NCS is terrible.  Just try to send them a DV letter or validation request.  They do not reply and are snotty in their calls and responses all the time.  If you are having issues with NCS, please let us know and we will do what we can to assist you.  :-)

I should be able to say that I am willing to help at any time, and I am.  This is not a violation of Fico forums.  My spouse and I brought ourselves out of the credit hole with this kind of personal help and anyone interested will get it also.  How is this self promotion.  This is self-less promotion.

anyone else having problems with this CA, aka NCS?  I know this thread is old but I've been doing lot's of research and collecting information on how to handle these scam artists.  I need to know if anyone have been successful with getting this bogus account off your credit reports and if so how did you do it?  I will not pay these people my hard earned dollars for debt I do not owe.  PLEASE HELP ME!!!
