not reporting correctly

Here is my situation, I did a reaffirm agreement on my mortgage and for some reason they stop reporting to the agencies..my question is that I’m about to apply for a auto loan and wondering should I mention that I do have a mortgage payment or should I just say nothing like the credit report says. Either way my DTI is fine I’m just curious to has any one else experience the companies not reporting. Does this help me or hurt me in this situation.

Re: not reporting correctly

When you say that they "stopped reporting," do you mean they ceased any updated reporting and the account still remains, or have they deleted the account, and thus are now not reporting anything?

The former is a violation of FCRA 623(a)(2), which mandates updated reporting if any item of information that has been reported has changed.

The later is not a violation, as credit reporting is voluntary, and any furnisher can choose to delete their entire prior account.

Re: not reporting correctly

The account still remains and I pay ever month for the past 2 years after my reaffirm and now they just stop reporting. It says now that it was included in my bankruptcy and that's not correct.

Re: not reporting correctly

Do state you indeed have a mortgage payment. Technically, do did file BK on the home, which you elected to keep. Thus requiring you to sign a reaffirmation agreement with the creditor to pay X for X months to keep the house. This would have been done shortly after the first creditors meeting.

Re: not reporting correctly

Is i did that back when i first did the chp7. It was reporting correct for 2 years stating also on the credit report that it waa reaffirm. And then after 2 years they put on the credit report that it was included with the bankruptcy.
