not the response I was expecting from EX... help please.

 I DV'ed a CA for an old apt complex bogus charge ( I vacated the property properly with DHs military orders...etc.) and this was from a year or so ago, and just now showing on report.. anyhoo, I gave the CA ample time( about 35 days) to furnish the necessary documents with a DV and follow up DV.  And received only an itemized list, nothing else.
 
I sent the following to EX along with a simple " They have not furnished the required documents, delete this account" that Noah has listed.
-copy of both certified mail receipts to CA
-copy of both GC to CA
-both my DV and follow up Dv letters to CA
-CRs response with itemized list.
 
 
And EX responded by stating that they do not require any additional information in their disputing process such as signatures etc, and they are not a mediator...etc
 
 
 So after doing all the DVs and CMRRR... EX is not going to do anything becasue they dont require this documentation and are treating it as a dispute...?
 
Please help you guys, this is my first for sending to a CRA.

A little confused. You use the abbr "CR" when talking about sending a DV, did you send the CA (Collection Agency) the DV?? Usually "CR" means "credit report."
 
If you sent it to the CA, I guess my other q would be, can you post the letter you sent to the CRA?? Maybe there was something in the wording that confused them???

To Whom It May Concern:

On February 28, 2008, National Credit Systems received my dispute of account #XXXXX, which they claim I owe to (OC) . I received the enclosed information from them, and sent them a follow up letter for validation of said debt, as their paperwork did not do; they received my follow up dispute letter on March 15,2008. They have not validated their claim in accordance with §809 FDCPA. Delete this disputed account.

 I have enclosed:

  • My initial dispute letter.
  • The Return receipt and certified mail receipt of this letter showing date they received it.
  • Their response documentation.
  • My second dispute letter
  • The Return receipt and certified mail receipt of this letter showing date they received it.

Please send any and all information to me in writing, and please send me a copy of my updated credit report.

The CRA is correct....they are only a go between...the creditor or CA reports to them....we can dispute what they are reporting BUT  if they continue to verify.....your complaint is with the CA and the OC NOT the CRA!
 
Have you tried to contact the OC (apt.complex)?  That is where it started.
 
You might need to consult an attotney.......A DV for rent is different then a CC or loan debt that is reporting inaccurate debt.
 
CRAs follow federal law....they only show on your CR what is reported to them. It is then up to us (you) to make the OC  CA to make corrections.

I contacted the apt complex and they dont have the paperwork anymore, they are under new management and send all "derogatory" information outward to a creditor... so no help there.
 
 The CA has admitted that they do not have anything else on this account other than the itemized list they sent me, so between the apt complex and the CA there is no other documentation to this. And that is because this is a bogus charge!- and a $ 700 at that.
 
 
I thought the whole point of doing a DV was so the CA had to verify, which, in this case,  they cannot do. Which other way do I go about getting it deleted if CRAs keeps verifying it their way??

 I think I can help you with this one something like that happen to me, the property had been sold and they did not have any records of my information. Thank God I had a copy of  all my paper work and sent it to the Apartment manager and had her send me a a letter stating I had paid and please delete the information.
 
I then sent that to all the CRA.
 
If the propertly is not will to do that then send the CRA the orders from your husband and your paid in full or last months rent recipet stating you would like to dispute the following and here is the information to back this up.
 
 
As long as you have your paper work they will write you a letter to delete if from your report.
