opinion needed for letter to CB

Is this what I need to send?  Too much, not enough?  Does it need to be stronger?
 

Dear Experian Credit Bureau,

 

This letter is a complaint that you are reporting inaccurate and /or incomplete credit information on my credit report.  This information as reported by you is highly damaging and injurious to my credit situation and is causing me to suffer as a result, including loss of past employment and other opportunities.

 

I am displeased that you have included the below information in my credit profile that includes the following errors.  Credit reporting laws ensure that bureaus report 100% accurate credit information.

 

In accordance with the federal Fair Credit reporting Act (FCRA), I respectfully request you investigate my claim and that you immediately delete the item.

In accordance with Public Law Sections d623a and 605c, a charge off can only remain on a report for a period of 7 years.  This account was charged off on 1/97 (10 years, 1 month ago) and you have failed to comply by law to remove this from my report in accordance to FCRA. 

 

You are also reporting a 30 day late payment on Feb 2006.  How can that be?  The account was sold to a third party who re-aged this acct.  They tried to re-age the account with Equifax by reporting a 30 day late on 7/2005 (which Experian does not show), but Equifax verified that this was a bogus report, just as the one you have listed for 2/2006 and what this 3rd party did is against the law!

 

It is interesting to note the following on this account:

 

On Oct 2005 I requested an investigation from you and another credit bureau on this account and Experian is the only one that did nothing about it and refused to remove it at that time.  The other credit bureau did the investigation and removed this account from my report.

MORE INFORMATION:

 

On 3/31/06 (hours between 4 an 5PM) I received a call from a unidentifiable number with no name and a man who stated he was an attorney for a third party who was trying to collect a debt that was purchased from Well’s Fargo.  He wouldn’t reveal who the 3rd party was, but he never did. 

 

When I asked him what this was for and stated that I had no idea what he was talking about, he said; “Oh, come on, you and I both know what this is for.” Then asked me to verify my social security number, which like a fool, I did.

 

I went on to say that the only thing I recall with Wells Fargo was a car purchase years ago, but that debt was no longer owed and everything had been handled years ago.  I had already had contact with Well’s Fargo about this and it had been removed from my credit report for falsification.

 

I also asked him if this was the debt he was referring to, then why was the amount quoted so much more than the original debt and he said it was interest fee’s and penalties.  I asked him if this was the case why did they wait 10 years to contact me.  He avoided my question.

 

I tried to explain that the original debt in the matter of the car, if this was what he was referring to, had been paid down to nearly half, then the car was given back and sole for the balance owed and the account was wrote off.  The statute of limitations has long expired.  I was trying to explain that I had already had contact with Well’s Fargo about this and it had been removed from my credit report with Trans Union, but he was very rude and wouldn’t listen to anything I was trying to say. 

 

He continued to talk over me and told me if I couldn’t be reasonable then he was going to crate a law suit against me and take me to court to collect this debt.  I could see that he only wanted to argue and threaten me, so I hung up on him.  To date, I have never heard from him again!

 

He is in violation of the Fair debt collection Practices Act.  This call took place just less than 30 days after the 30 – day late payment was posted to Experian that I never made!

 

I know that you need to report accurate information and will do the proper investigation and validate this account this time, as you do not want to harm anyone’s credit with inaccurate information.  Noting again that this account was charged off in 1997, you can clearly see that the SOL has ran out on this and probably do not even have to do an investigation, but simply remove this account from my report as it should have been removed a long time ago.

This is your last chance to report this item corectly prior to me filing suit in Federal Court for negligent noncompliance under § 617 of the FCRA.
 
Skip everything between MORE INFORMATION:
and the 30 – day late payment was posted to Experian that I never made!
 
If you want to persue this portion SUE the reporting party for FDCPA violations.

Thank you for your help.  How do I find out who the reporting party was?  I couldn't get any information from the guy on the phone.  The CB doesn't say who it was sold to, just that it was sold.
 
Do I need to include my social security number with this letter?

To the CRA - Yes include SSN and report number.

Is this common practise?  What would you suggest?  I never heard of such a thing.  I just want it gone off my CR.  Although it isn't effecting my employment any more, it did in the past. 
 
Was turned down for several jobs.   Was hired at a credit loan place as an assistant manager then let go a couple weeks later after the home offfice pulled my credit report.  Decided I couldn't get a break and became a free-lance person working for individual assignments that didn't check credit until I got enough experience to start my own company in the field. 
 
Heck, I was even turned down for a lousy $6.50 per hour job after I walked off a really good paying job thinking with my experience another good job would be right around the corner.  Boy did I ever get a shock!  this credit stuff can really kill you even just trying to get a job!
