pay to delete question

I was in the hospital for one night. First time ever in hospital overnight. Was sent 95,000 different hospital bills. I have insurance and just assumed they were all paid, but I had a 1500 co pay. Honestly never knew until I check my credit and saw it. I started paying payments but they were still putting negs on my credit. I was told to stop paying and just make a deal. If i was to ask for a pay to delete does it have to be paid in full. They will accept 400.00 probably.

Who told you to stop making paypments?  It remains delinquent until either paid or the debt is found not be be yours, so stopping payments does not seem prudent.

I assume the payments were being made to the OC?

If so, then stopping of agreed payments may result in their referral to a debt collector, and the addition of a collection to your CR, compounding your deletion problems.

 

Pay for delete is a private negotiation, and it is up to the parties to agree to terms.

They can certainly agree to accept less than the total debt as full discharge of the debt.

 

However, acceptance of a PFD in those situations is asking for two concessions.... CR deletion and accepting less $$.  It may have less chance of acceptance.

If they balk at a settlement for less, it might be worth the added $ to then counter with an offer to pay in full if they will then agree to CR deletion.

When I called Experian they told me if I pay payments it will still be delinquent. It was already in collections. Experian said better not to pay and make a settlement.

While continuing to make payments, you are showing actions towards settling the debt.

Ceasing any payments could result in escalation of actions on their part, such as charging off the debt, referral to collection if they have not yet done so, or legal action if still within SOL.    Yes, the debt will ermain delinquent until paid, but that does not equate to lack of any benefit to continue payments.

 

Unilaterally discontinuing efforts to pay is also unlikely to promote future feelings of good will on their part, which may direct their acceptance of either a settlement for less or acceptance of CR deletion.
