I was laid off from my job at the end of June, and found myself under a totally unrealistic non-compete that would have hamstrung me from continuing a 20-year career. I took my former company into mediation, and won both a red line of the non-compete, as well as a large settlement.
I was in the process of building a home when I was laid off, and thought I would lose the house. I continued to stay committed to the house while I fought my legal battle, as well as line up both independent consulting work for immediately following my mediation resolution, and ultimately interviewing at a company in my field, which offered me a job (start date is Jan 7). Ok,, so here are the details because I am a little concerned with my LOs ability to get this loan closed, and want to make sure I am ready to switch lenders asap if the UW comes back with an unfavorable response.
1) I had a BK in 2013 (dismissed, no debts, but included a foreclosure. House was sold for more than I owed, so I have no lien).
2) I have $235k cash on hand; will plan to put down 20%. Cash needed to close is $123k (439k is the loan amount with 7.25% interest b/c i have to go non prime due to the foreclosure)
3) My job offer letter is without unrealistic contingencies (just based on passing background etc. which I have).
4) Base salary for new job is $390k, $555k TCC
5) Mid Mortgage score of 703

The "niche lender" we are working with has stated that they will also need 30 days of paystubs from the new job, so i am assuming that is a funding contingency, however with so much cash on hand, I am wondering if they are going to actually need this once they see my assets?
Can someone please give me some idea of what I can expect? I have about $50k tied up in this house from earnest and upgrades I paid out of pocket for. I have a lot on the line here.. Thank you!
Update 12/21 (my birthday, how fitting!): After I wrote the above, I questioned needing to go to a niche lender when I knew I had a strong case as an exception for a conventional loan. My LO revised my application to go the conventional route. We went into Underwriting this morning, and received the approval with no conditions a few hours later.
I could not have asked for a better birthday gift. Thank you to those who commented. Hopefully this will help someone else that might have derog events in their past, for which they have overcome. Merry Christmas!!
No that's not possible. I will move lenders asap this week if she can't get the exception. She is going to talk to the loan servicer Monday. There are plenty of other nonprime lenders out there that would love to service my loan if they can't. Thank you all for your help. I really appreciate it.
