According to their guildlines , it has to be immediate family, so if that is her brother then yes she can join and sponser you. He doesn't have to be a member but makes sure she has DD-214 if needed.

Your mother should be able to join based upon her status as a sibling to a Navy veteran, with no need for him to become a member himself. After she joins, she can sponsor you for membership.
