@wasCB14 I have a real simple solution , If  Agent did not collect emd then agents e/o provider gets a claim for it. Yes the e/o will pay and yes they will drop the agent like a hot potaterier.   More saber rattleing and for real.  Tell agents broker your about to submit a $25K e/o claim and file a complains against the firm with california realestate commisssion.    Broker will panic and may just write you a $25K check,

Thanks for all these insights! I'm a generation younger than the trustees and have no official power, but I am putting these ideas forward as options.

 

So far, my mother (branch A) has been disinclined to fight her siblings' abusive behavior, but if things keep going the way they are, hopefully branches B and C will want to hold each other at least somewhat accountable.

 

What's really sad is that instead of the three branches just calmly and civilly taking 1/3 each, they're being so awful to others to try to eke their shares up to ~34.5% and my mom to ~31%...likely at the cost of alienating everyone outside their own branch. If they were going for significantly more (like 45/45/10), I could at least understand the rationality of it.

@wasCB14    Goodluck. Family and money never mix.   I have been going on a long term lawsuit with my sister over my mothers death.

Bottom line my sister is sleaz  and has tried to submit a very questionable will  into probate.    I hired the leading probate attorney in the state.

Now no one is getting any thing. I only want a fair split and am wiling to forget about the money my mother owed me  and the smaller sum I owed her.

We've had enough struggles with extended family, incompetent lawyers, and government agencies...and a modest enough lifestyle...that the immediate family has no interest in (or time and energy for) infighting. And we are on generally good terms.

 

But things are deteriorating rapidly with branch C (the agent/relative's branch) and if the buyers do fail to buy the house in a reasonable period of time, I think branches A and B will have no hesitation about pursuing an E/O claim if the EMD didn't appear or was returned.

@wasCB14   I too am fed up.  All I would really like to is sell all our restricted REIT shares and move away to an island..   Atleast this did not happen to you: DW fathers was upscale builder his whole life til around age 60. He built about 2 houses a year for celebraties and made a good living. He was really was never in it for the money and gave a ton of money ie over a million dollars in time money and crews to Habitat for Humanity.   About 1 month before father in law passed his brother passed and left him 1 million dollars in cash. He did not want it and  gave away to his his 2nd cousin who needed the money but never had even met him.   Father in Law did pay for DW tution to to an Ivy School  when she went to college and bought her new furniture when she divorced her first husband but that was it.  Every one assumed he was loaded but his estate at death was under $200,000
