I am assisting someone who is still currently living in a apt complex that has placed 6 judgments on their credit report....shouldnt they be able to have these removed if they are still living in the complex...it appears that if you are late that paperwork automatically goes to the lawyer to file paperwork.....
I would appreciate if someone can give some insight on how to go about getting these removed.
I believe that if you are late they give you a pay or vacate notice. If you pay in the alloted time, nothing should come of it. If you do not pay on time, they will go to court and get an eviction judgment.
As far as I know, it would take them actually getting the eviction judgment in order for it to be on the CR. And you would have to be served.
Maybe the complex was supposed to do other paperwork once it was paid and did not follow through. Has your friend talked to them?

Did they sign an agreement (their lease?) that gave the apartment complex permission to file for a judgment if rent was not paid on time?
Were they given notification that the complex was seeking a judgment? If these are truly judgments, they would have had to go to court.
It's difficult to give you advice on getting these removed until we know more of the details.
It looks like they have gone to court by looking at court documents online....some of the cases were dismissed and some of them had actually dollar amts associated with the judgement...in speaking to my friend they have paid everything and is the reason why they are still in the apt...they have been in the apt for at least 5yrs....
.it just doesnt seem right.... I will find out more info from them though......

It sounds like the judgments may be from a housing court. Some jurisdictions have special housing courts which can issue judgments in cases related to tenacy. Housing court judgments are legally valid, but the rules of operation in housing court are often light years away from the rules in normal courts so it's very difficult to say what is going on in your case and why it happened.
My opinion would be to contact the entity that has the judgment and obtain their case documents on each. Then you can see exactly what happened.
The good news is that most housing court judgments can be vacated once paid.

Since when does a landlord need your permission to file a judgment if your rent is not paid on time?
