Advice Please! SST/Cigpf1

Hi. I need advice about how to pursue this.

My hubby has a auto repo on his TransUnion only. It's from SST/Cigpf1 and goes back to 2001. It was repo'd in 01 and sold in 02. He has never received anything from SST/Cigpf1 until it showed up on his reports 6 months.  It's due to fall of Jan. 09, but we are trying to get a mortgage now, and this needs to be gone.
What should we do?? We asked for documentation and they came back with the original sales agreement 2 months later.

Re: Advice Please! SST/Cigpf1

If it was repo'd in 2001  it would mean that the DOFD would be in 2001.......this should drop in 2008!!!

It goes by DOFD  not date sold!

I would file a dispute!!!  fax or CMRRR

Send this letter to the OC  CMRRR   at the samw time as dispute.

RE: [insert account number or name of account or name of debt]:
Dear [insert collector's name or company name],
This letter is in response to your [letter dated xx-xx-2005] (copy enclosed) or [phone call on xx-xx-2005], concerning the collection of the above referenced [account or date].
I do not believe I owe what you say I owe therefore I dispute this debt. I am well aware of my rights under the Fair Debt Collection Practices Act (FDCPA) and my state laws so I hope to save both of us a great deal of time by letting you know that not only do I dispute the validity of this debt, I have also checked with my State Attorney General and verified that the Statute of Limitations for enforcing this type of debt through the courts in (insert your state or the state in which the contract was signed) has expired. Therefore, should you decide to pursue this matter in court I intend to inform the court of my dispute of this debt and that the "statute of limitations" has expired.
This letter is your formal notification that I consider this matter closed and demand that you, or anyone affiliated with your company, stop contacting me regarding this or any other matter except to advise me that your debt collection efforts are being terminated or that you or the creditor are taking specific actions allowed by the FDCPA or my state laws.
Be advised that I consider any contact not in accordance with the Fair Debt Collection Practices Act a serious violation of the law and will immediately report any violations to my State Attorney General, to the Federal Trade Commission and, if necessary, take whatever legal action is necessary to protect myself. Be advised that I tape record all phone calls and violations of the FDCPA can result in you or your company being personally fined up to $1,000 per incident.

Re: Advice Please! SST/Cigpf1

Does it matter if the OC sold the debt to SST/Cigpf1, would that extend the SOL????
Also, if I dispute with CRA's what would my statement be...that the DOFD was in 2001 with the OC? Do they care since it was sold to a CA?

If not, this is the best news I've received in a LONG time!

Thanks!

The only thing that might reset SOL is YOU making a payment!    In order to reset DOFD  you would have had to become current in your original payments   which you didn't!

If the OC is reporting you would first dispute & wait for it to be verified.....then you send the OC letter to the OC.   They should sen you your complete history. This will tell you when your first missed payment was.

Re: Advice Please! SST/Cigpf1

Thanks for the help.

I got some faxed verification from SST yesterday that showed the sale after repo in Feb 2002...the letterhead was from AutoNation.  I'm assuming they were the OC, hubby can't remember it was that long ago.

It shoud be due to fall of in a couple of months, but that's not soon enough for our loan officer. Should I send a dispute to TransUnion and just cross my fingers they delete being so close to deadline?

You can try to dispute as *obsolete*    just remember if it doesn't delete it will up date.
